RESOLUTION ORDERING VACATION
1 REAS, the City of Newport Reach did, on the 2_day.
2 of FEBRUARY , 19..9LJ,, pass its certain Resolution of Ia-
3 tention No. 40 , declaring its intention to'orea r the closing
4 up, vaoation and abandonment of a portion of a. street known as
5 Ocean Front between Prospect and 62nd Street in the City of
6 Newport Beach, hereinafter more particularly described, pursuant
7 to and in accordance with the 03treet Vacation Act of 1941" and
s all amendments thereto, being Sections 8300 throw $331 of the
9 California Streets and Highways Code; and
10 WHEREAS, the Street Superintendent of the City of Newport
11 Beach has caused to be posted conspicuously along the portion of
12 said street proposed to be vrZ;'Ited, not more than 300 feet apart,
13 and not lose than 3 in all, notices of the vacation of said por-
14 Lion of said street, all of which will more fully appear from
15 the affidavit of L. W.. Covert, the said Street Superintendent of
16 the City of Newport Beach, on file in these proceedings; abd
17 S1fiEAF..A.S, said notices so posted by the Street Superin-
18 tendent of the City of Newport Reach stated the preparation of
19 said Resolution of Intention No. 4035, aforesaid, andthe date
20 and place of the hearing of all persons interested in or object -
21 ing to the proposed vacation of said portion of said street; and
22 T9HEMS, the City Council of the City of Newport Beach
23 by said Resolution of Intention No. 4035, aforesaid, did fix
24 Monday, the 23rd day of March, 1953, at the hour of 7130 p.m.
25 ` of said day as the time and the Council Chambers of the City
26 Council of the City of Newport Beach, located in the City Hall

27 i of the City of Newport a()ach, as the place, for the hearing of
28 all persons interested In or objecting to the proposed vacation
29 ` of said portion of sale: street; and
30 WHEREAS, said Resolution of Intention No. 40351 afore -
31 said, has been published at least once in the Newport Harbor
32 j Ensign, a newspaper of general circuln.tion, printed published

and circulated in the City of Newport Beach, and said publicatien
was made more than 15 days prior to the date set for the hearing
of all persons interested in or obseoting to the proposed vaea-
tion, all of which will more fully appear by the affidavit of
Arvo Rasps, owner and publisher of said Newport Harbor Ensign,
on file in these proceedings; and

has heard the evidence, both written and verbal, of all persons
interested in the vacation of said portion of said. street in
this Resolution more particularly hereinafter described, and finds
from all the evidence submitted that said portion of said street
described, Is unnecessary for present or prospective public street
or alley purposes;
NOWS THMFORE, the City Council of the City of Newport
Beach finds and determines and hereby orders that the following
described portion of that certain street in the City of Neap ort
Beach, described as follows:
Beginning at the most southerly corner of
Lot 6, Block B. es shown upon a map of
Seashore Colony Traot, recorded in Miscel-
laneous Maps, Book L. rage 255, records of
Orange County, California; genoe north-
westerly along the southwesterly line of
said Lot 6 to fhe most westerly corner of.
said lot, thence Am.tLTsesterly along the
southwesterly prolongation of the north-
westerly line of said lot, a distance of
15.00 feat, thence southeasterly along a
line parallel to the eouthwesterly line of
said lot 6 to its intersection with the
southwesterly prolongation of the South-
easterly line of said lot 6, thence north-
easterly along said southwesterly prolonga-
tion a distance of 15 ft. to the point of
beginning.

The City Council further orders that the City Clerk of
the City of Neeraort Beach sha11 cause a certified copy of this
Order, duly attested by his as the City Clerk, under the seal of

the City, to be recorded in the office of the County Recorder of
orwige County, state of California, innediately following the
passage of this Resolution.
The above and foregoing 11asolution No. was duly
passed and adopted at a regular meeting of the City %Council of
the City Of Meuport =each, held on the 2 ri day at MARCH ,
1453, by the following vote, to -wit;
