ORDUITZIG VACJ- t TON 141EREAS, the City of Newport Beach did, on the llth day of Hay, 1953, pass its certain Resolution of Intention No. 4082, declaring its intention to order the closing up, vacation and abane meat of a portion of a street known as Via Genoa, in the City of Newport Beach, hereinafter more particularly described, pursuant to and in accordance with the "Street Vacation Act of 2941" and al] amendments thereto, being Sections 8300 through 8331 of the Calif- ornia Streets and Highways Code; and @1MEAS, the Street Superintendent of the City of Newport Beach has caused to be posted conspicuously along the portion of said street proposed to be vacated, not ,:yore than 300 feet apart, and not less than 3 in ail, notices of the vacation of said ports of said street, all of which will more fully appear from the affidavit of L. tote Covert, the said Street Superintendent of the City of Newport Beach, on file in these proceedings; and WHMAS, said notices so posted by the Street of the City of Newport Beach stated the preparation of said Resolution of Intention No. 4082, aforesaid, and the date and place of the hearing of all persons interested in or objecting to the proposed vacation of said portion of said street; and USTUIUS, the City Council of the City of Newport Beach by said Resolution of Intention No. 40821 aforesaid, did fix Monday, the 8th day of June, 1953, at the hottr of 7130 P.Pt, of Council said day as the time and the Council Chambers of the City/)bft of the City of Newl-ort Beach, located.in the City Hall of the City of Newport Beach, as the place, for the hearing of all persons inter..;ated in or objecting to the proposed vacation of said portion of said street; and H 3y� IM 1 V'HrREAS$ said Resolution of Intention Pao- 40$2' aforesaid, • 2 has been published at least once in the XeT_ -Port Ea rbcr Ensign, a 3 newspaper of gen4'ral circulation, printed published and circulated • 4 in the City of Newport Beach$ and said publication gas made more 5 than 15 days prior to the date set for the hearing of all persons 6 interested in or objecting to the pro}iosed vL�caticnn, all of which 7 I will more fully appear by the affidavit of Arvo Haapay owner and s publisher of said Newport Harbor Ensigns on file in these proceed- 9 ings; and to VHER sAS+ the City Council of the City of Newport Beach has 11 heard the evidence, both written and verbal, of all persons inter - 12 ested in the vacation of said portion of said street in this 13 Resolution more particularly hereinafter described, and finds from 14 all the evidence submitted that said portion of said street desert 15 ad, is unnecessary for present or prospective public street or 16 17 alley purposes; NOW., TT£�i. The City Council furtaer orders that the City clerk of the City of Newport Beach shall cruse a certified copy of this order$ duly attested by hips as the City LIerk, under the seal of the City, to be recorded in the office of the County Recorder of Orange County, State of Cfalifornia$ immeftately following the pa sage of this Resolution.
