1 RESOLUTION ORDERING VACATION

3 WHMMS, the City of Newport Beach did, on the 18th day
4 of April, 1955 ,pass its certain Resolution of Intention No. 4320
.5 declaring its intention to order the closing up, vacation and
6 abandonment of a portion of a street over Lot 24, Block 9, Tract
.7 27, and vacated street adjoining on the West, in the City of
8 Newport Beach, hereinafter more particularly described, pursuant
9 to and in accordance with the "Street Vacation Act of 1941" and
10 all amendments thereto, being Sections 8300 through 8331 of the
11 California Streets and highways Code; and
12 WHEREAS, the Street Superintendent of the City of New -
13 port Beach has caused to be posted conspicuously along he
g portion
14 of said street proposed to be vacated, not more than 300 feet
15 apart, and not less than 3 in all, notices of the vacation of said
16 portion of said street, all of which will more fully appear from
17 the affidavit of L. W. Covert, the said Street Superintendent of
18 the City of Newport Beach, on file in these proceedings; and
19 WHSAEAS, said notices so posted by the Street Superin-
20 tendent of the City of Newport Beach stated the preparation of
21 said Resolution of Intention No. 4320 aforesaid, and the date and
22 place of the hearing of all persons interested in -,r objecting to
23 the proposed vacation of said portion of said street; and
24 WHEREAS, the City Council of the City of Newport Beach
25 by said Resolution of Intention No. 4320 aforesaid, did fix
28 Monday, the 23rd day of May, 1955, at the hour of 7.30 P.M. of
27I1said day as the time, and the Council Chambers of the City Council

the City of Newport Beach, located in the City Hall of the City
Newport Beach, as the place, for the hearing of all persons
terested in or objecting to the proposed vacation of said portion
said street; and
WHEREAS, said Resolution of Intention No. 4320, aforesaid,

has been published at least once in the Newport Harbor Ensign, a

newspaper of general circulations, printed, published and circulated

in the City of Newport Beach..,-and said publication was made more
4
than 15 days prior to the date set for the hearing of all persons
5
interested in or objecting to the proposed vacation, all of which
6
will more fully appear by t affidavit of A. E. Haapa, owner
7
and publisher of said Newport Harbor Ensign, on file in these
8
proceedings; and

WHEREAS, the City Council of the City of Newport Beach
10
has heard.the evidence, both written and verbal, of all persons
11
interested'in the vacation of said portion of said street in this
12
Resolution more particularly hereinafter described, and finds from
13
all the evidence submitted that said portion of said street
14
described in said Resolution of Intention, and hereinafter described
15
is unnecessary for present or prospective public street or alley
16
purposes:

NOW, THEREFORE, the City Council of the City of Newport
18
Beach finds and determines and hereby orders that the following
19_
described portion of that certain street in the City of Newport
20
Beach, described as followas
21
A triangular shaped parcel of land being a portion
of that portion of Lot 24, Block 9, and vacated
22
street adjoining on the West as shown upon a map
of Tract No. 27 recorded in Miscellaneous Maps Book
23
9, page 26, Records of Orange County, State of Calif-
ornia, that was granted to the State of California
24-
for a public highway and described in deed record -
ed in Book 809, page 86, Official Records, Records
25
of Orange County, California, and more particularly
described as follows:

Beginning at a point in the northwesterly line of
27
the 80 foot strip of land described in deed from
John J. Thornton et al to the County of Orange, re-
28
corded in Book 72, page 131 of Official Records of
said Orange County, which point is the southerly
29
end of that certain tangent course in said north-
westerly line having a length of 157.44 feet and a
30
bearing of South 34° 59' 35" West; thence from said
point of beginning.South 340 59' 35" West along the
31.
southwesterly prolongation of said tangent course
a distance of. 297.75 feet to a point in the center
32
line of that certain 40 foot street adjoining said

Lot 24 on the west ai vaeated by the Board of Super-
visors of said Orange County, a certified copy of
which order is recorded in Book 286, page 273 of
Official Records, records of said Orange County;
thence South 80° 40' 1.0" East a distance of 32 feet;
thence North 240 55' 51" Bast to a point of inter-
section with the::;,Aid northwesterly line of the
aforementioned 8(Yt'oot strip of land, said point
of interesection being in a curve concave to the
Southeast and having a radius of 1040 feet; thence
northeasterly along said curve and said northwest-
erly line to the point of beginning.

Purposes, and now makes its order vacating said portion of said
street above described.
The City Council further orders that the City Clerk of
the City of Newport Beach shall cause a certified copy of this
Order, duly attested by him as the City Clerk, under the seal
of the City, to be recorded in the.office of the County Recorder
of Orange County, State of California, immediately following the
passage of this Resolution.
The above and foregoing Resolution No. 43 ?OA was duly
passed and adopted at a regular meeting of the City Council of
the City of Newport Beach, held can the 23rd day of May
by the following roll call vote, to wit: '
