WHEREAS, the City of Newport Beach heretofore initiated

proceedings under the Uninhabited Territory Act of 1939 to annex
5
to said city certain territory designated and known as "Upper Bay
6
Annex "; and

WkM1EAS, the County of Orange, State of California; The
8
Irvine Company, a corporation; George Hoag, II, also known as
s
George Hoag, Jr. and Edwin L. Munsey are each ovm era of property
10
located within the said territory to be annexed, and it appearing
11
that said County of Orange; The Irvine Company, a corporation}
12
and said individuals are the only owners of any property within
13
said territory; and
14
WHEREAS, the hearing of.proteste made by any person,
15
political subdivision or corporation owning any real property withii
16
the said 'territory proposed to be annexed was stfor April 1$, 1955s
17
at the hour of 7 :30 00010ck p.m. in the Council Chambers of the
18
City Hall, 3300 Newport Blvd., Newport Beach, California; and
19
WH RMS, that before the hour set for hearing objections,
- 20
said County of Orange filed a written protest against the annexa-
21
tion, a copy of said protest being dated April ll, 1955 and in
22
*words and figures as follows, to wit:

"'The County of Orange being the owner of all of the tide
24
and submerged lands within that portion of the Newport Upper Bay
25
included within the territory described in the 'Upper Bay Annexa-
26
tion to the City of Newport Beach, hereby protests the 'Upper Bay
27
Annexation to the City of Newport Beach'.

°The tide and submerged lands owned by this protestant

consists of-approximately 620.acres in area and represents more
30
than one -half of the value of the territory included in the 'Upper
31
Bay Annexation to the City of Newport Beach'.

"Wherefore, this protestant prays that the said annexation
