1 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT
• BEACH, CALIFORNIA, ASCERTAINING AND DETERMINING THE
2 PREVAILING RATE OF WAGES TO BE PAID FOR THE FOLLOW-
ING PUBLIC IMPROVEMENT IN THE CITY OF NEWPORT BEACH
3 IN 31ST STREET AND OTHER STREETS AND RIGHTS OF WAY.
• 4 WHEREAS, the City Council of the City of Newport Beach,
5 California, did on the 2 7th day of December, 19559 adopt
6 Resolution of Intention No. 4421 for the construction of
7 certain paving, sidewalks, curbs, gutters, sanitary severs,
8 drainage structures, water service connections and an ornamental
9 lighting system in 31st Street and other streets and rights of
10 way, and appurtenant work in connection therewith; and
11 WHEREAS, pursuant to the provisions of Section 1 773 of

12 the Labor Code of the State of California, it is necessary that
13 the City Council of the City of Newport Beach ascertain and
14 determine the general prevailing rate of wages on public works,
15 and the provisions of said Code make it mandatory upon the
16 awarding body of any public contract where said body subse-
17 quently calls for bids for any public improvement to ascertain
18 and determine the general prevailing rate of per diem wages in
19 the locality in which the work is to oe performed, for each
20 craft or type of workman or mechanic needed to execute the
21 contract, and also the general prevailing rate for legal holiday
22 and overtime work for each craft or type of workman or mechanic,
23 NOW, THEREFORE, the City Council of the City of Newport
24 Beach, California, has ascertained and does hereby determine
25 that the general prevailing rate of per diem wages in the local -
26 ity in which said work described is to be performed in the matte
27 of certain public improvements for the construction of certain
• 28 paving, sidewalks, curbs, gutters, sanitary sewers, drainage
• 29 structures, water service connections and an ornamental light -
30 ing system in 31st Street and other streets and rights of way
31 in the City of Newport Beach, California, for each craft or
32 type of workman or mechanic needed to execute the contract,
16 The above listed rates are based upon a working day of
eight (8) hours, being proportionately applicable to eight (8)
17 hours or less of employment in any one calendar day other than
Saturdays, Sundays and the following seven legal holidays,
18 to wits New Year's Day, Memorial Day, Fourth of July, Labor
19 Day, Armistice Day, Thanksgiving and Christmas, where any work
is required in case of extraordinary emergency caused by fire,
flood or danger to life or property. For any working time of
20 more than eight (8) hours in any one calendar day and for time
21 worked on Saturdays, Sundays and any of the aforementioned hol
not less than one and one -half times the specified rates shall
22 be paid.
23 ADOPTED by the City Council, signed by the Mayor and
24 attested by the City Clerk this 13th day of February, 1956.

and also the general prevailing rate for legal holiday and

in accordance with the schedule.

Any classification omitted herein shall be paid not
less that $2.075 per hour.

Holiday, Sunday and overtime employment is not usually
6
permitted, but if allowed, wages shall be one and one -half
times the above rates.

The rates of wages, including over.tlme, holiday and
8
Sunday rates, as just specified, are subject to the effect,
if applicable thereto, of executive orders of the President
9
of the United States No. 9240, dated September 9, 1942, and
No. 9350, dated October 3, 1942, to any modifications thereof
10
and to any and all lawful orders of the President or any other
authorized Federal officer or agency, insofar as the same may
11
be applicable to this contract. In case of any inconsistency
or omission, the rates fixed by any such applicable Federal
12
order, whether higher or lower, shall control.

In accordance with the provisions of Section 1777.5 of
the Labor Code, as amended by chapter 971, Statutes of 19399
14
and in accordance with the regulations of the California
Apprenticeship Council, properly indentured apprentices may
15
be employed in the prosecution of this work.
16 The above listed rates are based upon a working day of
