iROWA3, the City Council Of the City of Newport- Beech
On July 15, 1946 ordered the vacation and abandonment of a portion
of a certain street and certain alloys in the City of Newport
Beach as hereinafter described, and which order was entered
in the minutes for the Council meeting of July 15, 1946; and
NItMMS.. through inadvertence said order was not not
forth in a written resolution; and
WHYS, the City of Newport Beach did on the 27th day
of Nay, 1946, pass its certain Ordinance of Intention No. 547
declaring its intention to order the closing up, vacation and
abandonment of a portioti of ocean Front, and of certain alleys, in
the City of Newport Beach, hereinafter more particularly described,
ipursuant to and in accordance with the "Street Vacation Act of
1941" and all amendments thereto, being Sections 8300 through 8331
,of the California Streets and Highways Code; and
WHETS, the Street Superintendent of the City of Neew-
port Beach has caused to be posted conspicuously along the
portion of said street and alloys proposed to Ve vacated, not mare
than 300 feet apart, and not less than 3 In all, notices of the
vacation of said portion of said street and said alleys, all of
which will more fully appear from the affidavit of L. W. Covert,
the said Street Superintendent of the City of Newport Beach, on
file in these proceed4ngs; and
WHEMS, said notices so posted by the Street Superin-
`tendent of the City of Newport Beach stated the preparation of
,said Ordinance of Inteention No. 547 as.foressid, and the date
and place of the hearing of all persona interested in or objecting
Ito the proposed vacation of said portion of said street and said

by said ordinance of intention No. 547, aforesaid, did fix
DWnday, the 15th day Of July, 1946, at the hour of 4soo p.m.
of said day as the time aqd the Council Chambers of the City
Council of the City of Newport Beach, located in the City ball
of the City of Newport Boaaoh, as the place, for the hearing of
all persons interested in or objecting to the proposed vacation
of said portion of said street, and
wEi =S, said Ordinance of Intention No. 547, aforesaid,
has been published at least once in the Newport Balboa N -Times,
a newspaper of general circulations, printed, published and air -
eulated in the City of Newport Beach, and said publication was
made more than 15 days prior to the date set for the hearing of
all persons interested in or objecting to the proposed vacation,
all of which will more fully appear by the affidavit of S.A. ftyaar,
printer Of said Newport - Balboa News 'times, On file in these
proceedings; and
MOMS$ the City Council of the City of Newport Beaoh
has heard the evidence, both written and verbal, of all persons
interested in the vacation of said portion Of said street and
said alleys in this resolution more partieularly hereinafter
described, and finds from all the evidence submitted that acid
portion of said street and said alleys described area unnecessary
for present or prospective public street or alley purposes;
Note, SRS, the City Council of the City or Nit
Beach finds and determines that the following described portion
of a certain stmt, in the said city and of certain alleys, as
hereinafter described, in said city are unnecessary for present or
prospective public street or alley purposes and further finds
and determines that as to alley ,#22, as hereinafter described,
the public convenience and necessity require the reservation of
easements and right of ways for the following purposes, to wits

1 to construct, maintain, operate, replace, remove and renew
2 sanitary sewers, water mains, and storm drains, and appurtenant
3 structures in, upon, over and across the said alley* #2, and to
4 maintain, operate, replace, remove, renew and enlarge lines of
5 pipe, conduits, cables, wires, poles and other convenient struet
g for the operation of gas pipe lines, telegraphic and telephone
7 lines, and for the transportation, or distribution of electrical
g energy, water, and incidental purposes, including aecess and the
9 right to keep the property free from inflaeable materials and
10 wood growth, and otherwise protect the name from all hazards
11 in, upon and over the said alley X62.

14 that certain street In the City of Newport Beach and of certain

portion of Ocean Front, as shown upon a map
18 of Seashore Colony Tract, recorded in Miscel-
laneous Maps, Hook 7, page 25, Records of Orange

Beginning at the most southerly corner of Lot 1,
all Block L of said Seashore Colony Tract; thence,
northwesterly along the northeasterly line of

The above and foregoing Resolution 4441, was duly
passed and adopted at a regular meetlrg of the City Council of
the City of Newport Beach, hold on the 131hday of Febrwary
