RESOLUTION NO. 4 c00 0
SAS, there has been duly presented to the City
Council of the City of Newport Beach a certain Agreement for
Architectural Services dated the �� day of

1957, by and between J. Herbert Brownell and the City of 'Newport
Beach; and
SAS, the City Council has heretofore considered the
terms and conditions of said agreement and said terms and
conditions are reasonable and equitable.
NOWO TUERWORE,* BE IT RESOLVED that the Mayor and the
City Clerk be, and they are hereby, authorized and directed to
execute said amendment to agreement in the name of and for and on
behalf of the City of Newport Beach.
The above and foregoing resolution was duly and
regularly passed and adopted by the City Council of the City of
Newport Beach at a regular meeting thereof held on the 25th day
of February, 1957, by the following roll call vote, to wit.-

Includes the preparation of floor piano, elevatifts, sections
and intericars necesssrbt, larie seals and full six* arohitsetwml,
structural and meabo meal engineering details, complete typewritten
09e1fieations, twelve in number, including specifieatU ne for
e441pssant, and twelve sets of blueprints for plan chacking and
eorstruettion purposes.
TAM : SUMMION OF CCl¢dMCTIQN. This service
includes analyzing the bids of the contractors, assistance in the
prepamtIon of the ag ants, the approval of all bills for pay -
Monte to the contractors, the Sapirag of a record of payments
nada, and rendering architectural supervision of the worts. The
Architect will endeavor to protect the City against any deficiencies
in the work of the contractors, but does not Warentee the petr-
fwnzuae of their contracts. The Architectural 9uparvision is
the customary supervision of the Architect.
(8) COST CP TIM WMI It has been stated horeinbefore
that the eppFOdewnte construction cost of the buil Ung covered
by this contrast is to be 05,000c00, which shall unlade all
eosto, sxelusive of the architect's foss, costs of soil tests or
material tests, inspection Coates permits and cbbeldag foss, and
advertising oasts. The Architect stall prepare the preliminary
studies and all slnetches, and shall endeavor to c000lete the
working dIvftI W and specifications in such a mfr tdsat the
total construction colts shall not exceed said ammmt.
The Arcbitect further agrees that should the lowest
bonsfift bid obtained within 90 days from the date of the
appravel of the plans and specifications by the City exceed said
mount by more than 10%* he will, if wired by the City,
revise said working dravinge and specifications in such mannerr

project or substantially the same project, the City for such
purpose shall have the privilege of:
(1) 'Utilizing any paWleted drawings, specifications,
estimates and other co l_eted contract dootments prepared under
this agreement by the Architect who shill make them available
to the City upon request without additional ootWensation; and
(2) Requiring the completion by the Architect of any
and all Bali cqMple_te drt+wings, specifications, estimates,
and other partially Meted contract documents. and the delivery
of such documents towthe City, in consideration of which the
Architect shall be paid 'by the City an amount which represents
the value of the additional services performed computed in the
eame mauler as above provided for the computation of the Architect's
compensation upon the termination of this agreement,
of the City, the Architect should fail to perform and prosecute
his assigramt efficiently and with reasonable dillgence and
without unusual delay, or if the Architect should fail to perform.

event of a substantial failure of performance by such other
