HomeMy WebLinkAbout4819 - On-Street & Off-Street Parking in CityWWC:mec 5/27/58 RESOLUTION NO. 4819 \" A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH ESTABLISHING POLICIES RELATING TO ON- STREET AND OFF- STREET PARKING THROUGHOUT THE CITY WHEREAS, residents and businessmen have formally and 1 1^ '✓ informally submitted a variety of requests for action by the City concerning parking; and WHEREAS, the City Council has examined the current status of on- street and off - street parking facilities through- out the City; and WHEREAS, the orderly development of on- street and off- street parking facilities requires the application of uniform and consistent policies by the City government; and WHEREAS, the City Council considers the following find- ings and objectives to be valid and in the public interest; 1. Adequate parking in business areas is necessary for the economic health of the businesses and the City; 2. There is a current and urgent need for the orderly development of both on- street and off - street parking in the various business districts of the City; 3. Use of parking meters to promote curb parking turnover is preferable to the less effective, less efficient and more costly system of posted time limits and tire - marking patrols; 4. The provision for off - street parking in business districts is the responsibility of owners of business property and businessmen, and such owners and businessmen should take the initiative in creating such parking since they are the primary beneficiaries; 5. Formation of parking districts under State ena- bling legislation whereby the cost of parking improvements is borne and equitably distributed among benefitting prop- erties is a desirable and workable solution to business parking needs and will be encouraged by the City; 3•G' 6. The City owns certain properties that can be made available for off - street parking; 7. Many problems in addition to parking result from the increasing number of people in automobiles coming to the City for recreation; 8. The tax - paying resident and businesses of the City bear most of the financial burden of the City services necessitated and enjoyed by recreation - seeking visitors; 9. Paid parking in recreational areas is one of the few practical means of recovering a portion of the cost of the City services enjoyed and necessitated by visitors; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Newport Beach hereby adopts the following policies: A. Business Area, on- street parking: 1. The City has the final responsibility to designate areas and determine locations for parking meter installations, but will take into consideration evidence of substantial demand from the affected businesses in exercising such responsibility. 2. The hourly rate for meters in business areas will be $0.05. The City will consider any reasonable requests to adjust parking time limits or increase the hourly rate. 3. Except in unusual circumstances, metered parking will be confined to areas zoned for business. B. Business Areas, off - street parking: 1. Provision for such parking shall be the primary responsibility of the business community, but the City will give technical assistance to areas initiating the formation of off- street parking districts. 2. The City may contribute a portion of business area parking funds collected within a parking district toward the retirement of the district's obligations. Where such funds are not being generated, the City will consider the installation of meters for such purpose. IL, 3. Available City -owned property suitable for off- street parking in business areas may be offered to private interests on a bid basis for development and operation as pub- lic, customer, or employee parking lots. 4. City -owned and operated parking lots shall be operated on a revenue producing basis. C. Recreational Areas: 1. The City will consider installing meters in any area, regardless of zoning, upon finding that the area is con- sistently used by visitors; providing such installations are not in conflict with the interests of residents, merchants and property owners. 2. The City will fix the time limits and days of operation for meters in such areas as necessary to obtain the optimum opportunity for parking without unduly inconveniencing the City's residents. 3• The hourly rate for meters in recreational areas will be $0.10 or higher as necessary to accomplish the objectives. D. Parking Revenues: Parking revenues will be accounted for by type (Business Area; Recreational Area), and by area of origin. The City will not commit the expenditure of parking monies solely on the basis of type or area of origin, but will use the funds as needed on a City -wide priority basis unless committed in a parking district development. 1. Expenditure of business and recreational area parking revenues derived from on- street meters shall be restricted to purposes substantially connected with traffic control and regu- lation, including, traffic enforcement; traffic engineering; traffic circulation; purchase of off - street parking facilities; signalization; street signs; traffic enforcement officers' salaries; and the purchase, installation, supervision, protec- tion, inspection, maintenance and operation of parking meters finding by the City Council that a proposed expenditure of these 1Fa funds is consistent with the above purposes shall be necessary I-- before any such expenditure is made. 2. Expenditure of business and recreational area parking revenues derived from off - street parking may be used for the purposes outlined in paragraph D -1 above or other purposes necessitated by recreational traffic on City streets and beaches. This Resolution was adopted by the City Council of the City of Newport Beach at a regular meeting on the 26th day of May, 1958, by the following vote, to wit: AYES, COUNCILMEN: NOES, .
