. 2 A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NEWPORT BEACH APPROVING THE
• 3 SUBSTITUTION OF FIRST WESTCLIFF CORPORATION
FOR THE BRADLEY COMPANY IN THE AGREEMENT
4 1 FOR THE SUBDIVISION IMPROVEMENTS IN TRACT
NO. 1896

6 WHEREAS, the City Council by Resolution No. 4956 on
71 March 23, 1959, approved a subdivision agreement with The Bradley
8 Company for the construction of improvements in Tract No. 1896; and
9 WHEREAS,.the City accepted a letter of credit in the
loll amount of $95,000 issued by the California Bank to guarantee the
11 construction of the subdivision improvements as provided in said
12 agreement; and
1311 WHEREAS, on April 30, 1959, The Bradley Company advised
1411 the City that it conveyed title to Tract No. 1896 to First West-
15 cliff Corporation and requested that First Westcliff Corporation
16 be substituted for The Bradley Company as subdivider under the
171 aforesaid agreement; and
18 WHEREAS, First Westcliff Corporation agrees to perform
19 all of the work required of the subdivider under said agreement and
20 to be bound by all of the terms and conditions of said agreement;
21 I NOW, THEREFORE, BE IT RESOLVED that, subject to the pre -
22 1sentation of a new letter of credit in the same form and amount
23 guaranteeing the completion of the subdivision improvements by
24 First Westcliff Corporation, the City of Newport Beach hereby
25 consents to the substitution of First Westcliff Corporation for The
26 Bradley Company as subdivider in the agreement authorized by
27 Resolution No. 4956 and that said agreement be deemed amended in
28 this respect.
• 29 This resolution was adopted by the City Council of the
30 'City of Newport Beach at a regular meeting on the 25th day of May,
31 1959, by the following vote, to wit:

the foregoing Resolution No, 5022 was duly and
regularly adopted, passed, and approved by the City Council of
the City of Newport Beach, California, at a regular meeting of
said City Council held at the regular meeting place thereof, on
the 25th day of May , 1959, by the following
vote, to wit:
