III . RESOLUTION NO. 5 055
2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEAJPORT BEACH AUTHORIZING THE EXECUTION OF
3 A CONTRACT TO SERVE WATER OUTSIDE THE CITY
BOUNDARIES TO NICOLAI & CHRIST

5I WHEREAS., there has been presented to the City Council of
6 the City of Newport Beach for its acceptance and approval a certain
7 contract by and between the City of Newport Beach and Nicolai &
8 Christ, wherein said City of Newport Beach agrees to sell certain
9 excess water of said City to Nicolai & Christ, upon the conditions,
10 covenants and restrictions as therein set forth; and
11 WHEREAS, said City Council has heretofore considered the
12 terms and conditions of said contract and said terms and conditions
13 1 are reasonable and equitable;
14 NOi,,J, THEREFORE, BE IT RESOLVED that that certain contract
15 between the City of Newport Beach and Nicolai & Christ, wherein the
16 City of Newport Beach agrees to sell certain excess water upon
17 certain conditions, restrictions and limitations to said Nicolai &
18 Christ, be approved and the Mayor and City Clerk are hereby author-
19 ized and directed to execute the same on behalf of the City of
20 Newport Beach.
21 This resolution was adopted by the City Council of the
22 City of Newport Beach at a regular meeting on the 13th day of July.
23 1959., by the following vote, to wit:

Beach, California, do hereby certify that according to the records
of the City of Newport Beach filed and ,daintained in my office,
the foregoing Resolution No. 5055 was duly and
regularly adopted, passed, and approved by the City Council of
the City of Newport Beach, California, at a regular meeting of
said City Council held at the regular meeting place thereof, on
the 13th day of July , 1959, by the following
vote, to wit:
AYES, COUNCILMEN: Kingsley, Atkinson, Stoddard, Hart,
Lorenz, Somers
NOES, COUNCILMEN: None
ABSENT, COUNCILMEN: Higbie
