2 A RESOLUTION OF THE CITY COUNCIL.OF THE CITY
OF NEWPORT BEACH AUTHORIZING THE EXECUTION OF
3 A LEASE AGREEMENT.

5 WHEREAS, Newport Beach School District owns Block 13 of
6 Newport Beach, as per map recorded in Book 4, page 27, Miscellane-
7 ous Maps, Records of Orange County„ California, and operates a
8 public elementary school on said blocks and
9 WHEREAS, the School District requires the use of Block
10 13 A and a portion of the tidelands and filled lands fronting upon
11 said Block 13 and Block 13 A to provide a playground area for use
12 in connection with said school; and
13 WHEREAS, it would be in the public interest for the City
14 to lease a portion of the tidelands and filled lands for said
15 purpose and to extend a right to School District to use Block 13 A
16 for playground purposes; and
17 WHEREAS, a lease agreement has been prepared in which
18 the City leases certain tidelands and filled lands to the School
19 District and grants a license and right of trespass to School
20 District for playground purposes over said Block 13 A and a portioi
21 of the tidelands and filled lands adjoining said property for a
22 term of fifty years; and
23 WHEREAS, said agreement provides that it is subject to
24 the approval of a majority vote of the electors voting thereon;
25 NOW, THEREFORE, BE IT RESOLVED that the Mayor and City
26 Clerk are hereby authorized and directed to execute said lease
27 agreement between the City of Newport Beach and the Newport Beach
28 School District, in which the City leases to the School District
29 for a term of fifty years the following- described property:
30 Beginning at the southerly corner of Lot 1 of
Block 13, Section B. of Newport Beach, as per map
31 recorded in Book 4, page 27, Miscellaneous Maps,
Records of Orange County, California; thence
32 southerly along the southerly prolongation of the

easterly line of said Lot 1 a distance of 400 ft.;
thence westerly along a line parallel to and 400
ft. southerly of the south line of said Block 13
to a point in the southerly prolongation-of the
westerly line of Lot 13 in said Block 13; thence
northerly along said southerly prolongation of the
westerly line of said Lot 13 to the southerly line
of said Block 13; thence easterly along the south-
erly line of said Block 13 to the point of beginning;
excepting therefrom Ocean Front street right- of -way,
and further excepting Block 13 A, Section B, of
Newport Beach, as per map recorded in Book -4, page
27, Miscellaneous Maps, of said Records of Orange
County,
and in which the City grants a license and right of trespass to
said School District for playground purposes only for a term of
fifty years over the following - described property:
Block 13 A, Section B; Newport Beach, as per map
recorded in Book 4, page 27, of.Miscellaneous
Maps, Records of Orange County, California.
This resolution was adopted by the City Council of the
City of Newport Beach at a regular meeting on the as" &1 day of

Beach, California, do hereby certify that according to the records
of the City of Newport Beach filed and maintained in my office,
the foregoing Resolution No, 5152 was duly and
regularly adopted, passed, and approved by the City Council of
the City of Newport Beach, California, at a regular meeting of
said City Council held at the regular meeting place thereof, on
