FkESREAS, the City Council of the City of Newport Beachl
did, on the 14th day of December, 1959, pass its certain Resolu-
tion of Intention No. 5137, declaring its intention to order the
vacation, closing up and abandonment of portions of certain
streets 1mcgn as Lancaster Street and Walnut Street in the City
of Newport Beach, hereinafter more particularly described,
pursuant.to and in accordance with the F'Street Vacation Act of
1941", and all amendments thereto, being Sections 8300 to 83312
inclusive, of the Streets and Highways Code of the State of
California; and
UNGI vAS, the Street Superintendent of the City of
Newport Boach has caused to be posted conspicuously along -the-
lines of the portions of said streets proposed to be vacated,
not more than 300 feet apart, and not less than three in all,
notices of the vacation of said portions of said streets, all
of which will more fully appear from the affidavit of L. N.
Covert, Street Superintendent of the City of Newport Beach, on
file in these proceedings; and
MIMIMS, said notices so posted by the Street Superin-
tendent of the City of Newport Beach stated the passage of said
Resolution of Intention No. 5137 aforesaid, and the time and
place of the hearing of all persons interested in or objecting
to the proposed vacation of said portions of said streets; and
MER.AS, the City Council of the City of Newport Beach
did set Monday, january 11, 1960, at 7:30 P. K. of said day as
the time, and the Council Chamber of the City Council of the
City of Newport Beach, located in the City Ball of the City of
Newport Beach, as the place, for the hearing of all persons

interested in or objecting to the proposed vacation of said
portions of said streets; and
WHEREAS, said Resolution of Intention No, 5137 afore-
said has been published at least once in the Newport Harbor News
Press, a newspaper of general circulation, printed, published and
circulated in the City of Newport Beach, and said publication was
made more than 15 days prior to the date set for the hearing of all
persons interested in or objecting to the proposed vacation, all
of which will more fully appear by the affidavit of Ben Reddick,
owner and publisher of said Newport Harbor News Press, on file in
these proceedings; and
WHEREAS, said hearing was opened on January 11, 1960,
and evidence taken; and
WHEREAS, said hearing was continued to February 8, 1960,
to February 23, 1960 and to February 29, 1960 to take additional
evidence on said matter; and
WHEREAS, the City Council of the City of Newport Beach
has heard the evidence, both written and oral, as aforesaid, of
all persons interested in the vacation of said portions of said
streets in this resolution more particularly hereinafter described,
and finds from all the evidence submitted that said portions of
said streets described in said Resolution of Intention, and here-
inafter described, are unnecessary for present or prospective
public street purposes;
NOW5 THE!`EFORE, the City Council of the City of Newport
Beach finds and determines and hereby orders that the following
described portions of those certain streets known as Lancaster
Street and Walnut Street in the City of Newport Beach, to wit:
Those certain portions of Lancaster Street, 40 feet in
width, as shown upon a map.of Tract No. 772, recorded
in Book 23, pages 5 and 6, Miscellaneous Maps, records
of Orange County, California, and more particularly
described as follows, to wit:

Parcel 1°
Beginning at the most southerly corner of Lot 1,
Blocs 18, as shown upon said map of Tract No.
772; thence northwesterly along the.southwest-
erly I ine of said Lot 1 to the most westerly
corner thereof; thence southwesterly on a
straight line to the most northerly corner of
Lot 14, Block 2, as shown upon said map of
Tract No. 772; thence southeasterly along the
northeasterly line of said Lot 14 to the most

northeasterly-line of said Lot 15 to the wDst east-
erly corner thereof; thence northeasterly on a
straight line to the point of beginning.

Beginning at the most southerly corner of Lot 1,
Block 17, as shown upon said map of Tract Tic. 772;
thence northwesterly along the southwesterly lines
of said Lot 1 and Lot 2 of said Block 17, to the
most westerly corner of said Lot 2; thence south-
westerly along the southwesterly prolongation of
the northwesterly line of said Lot 2 to an inter-
section with the center line of said Lancaster
Street; thence southeasterly along said center
line to an intersection with the northeasterly
prolongation of the northwesterly line of Lot 14,
Block 3, as shown upon said map of Tract No. 772;
thence southwesterly along said northeasterly
prolongation to the most northerly corner of said
Lot 14; thence southeasterly along the northeast-
erly line of said Lot 14 to the most easterly
corner thereof; thence northerly on a straight

The City Council further farads and determines, and it is

hereby ordered, that the public easement in the portions of said
streets as heretofore described has, upon the passage of this
resolution, ceased.
The City Council further orders that the City Clerk of
the City of Newport Beach shall cause a certified copy of this
Order, duly attested by her as the City Clerk, under the seal of
the City, to be recorded in the office of the County Recorder of
the County of Orange, State of California, immediately following
the passage of this resolution.
This resolution was adopted by the City Council of the
City of Newport Beach at a special meeting on the 29th day of
February, 1960, by the following vote, to wit:
