3 MCDIFIC.ATICN OF CONCESSION AGRZZIZ -:NT -

5 WIiEREAS, Concession Agreement, Corona del Mar State and
6 City Beach Park, was made and executed March 28, 1960, by and
7 between the City of Newport Beach and Donald W. Tosh and Ian 1;.
8 Tosh, doing business as Tosh Bros., hereinafter referred to as
9 4'Concessionaire''; and
10 [JIMERIAS, Concessionaire has requested that the corporate
11 surety bond required by the provisions of subparagraph (d) of para-
12 graph 3 of said concession agreement be reduced from a sum of not
13 less than $30,000 to a sum of not less than $20,000; and
14 MMMAS, a modification of concession agreement has been
15 prepared which, if approved, would require a corporatesurety bond
16 in a sum of not less than $20,000, which said modification has been
17 reviewed and found to be fair and equitable and it is in the interes
18 of the City to execute the same;
19 Wajb TMIAUFORE, BE IT RESOLVED that the Hayor and City

Clerk are hereby authorized and directed to execute said modifica-
tion of concession agreement on behalf of the City of Newport Beac
