2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH ACCEPTING A GRANT-OF-EASEMENT

4 WHEREAS, K. W. Koll Enterprise, Inc., has executed a
5 grant of easement to the City of Newport Beach conveying an ease -
6 ment for the purpose of installing, constructing, improving,
7 repairing, replacing and maintaining a storm drain and appurtenance
8 in, over and under that certain real property situated in the City
9 of Newport Beach, County of Orange,.State of California, described
10 as follows:
11 The Southerly 5.00 feet of that certain parcel of land
situated within Lot 104 of Tract No. 300 as shown on a
12 Record of Survey-Map recorded in Book 48, page 3 of
Record of Surveys of Orange County, California, the
13 boundary of which is described as follows:
14 Beginning at the intersection of the Westerly boundary
of Tract No. 3138 as per map recorded in Book 103
15 pages 31 through 33 inclusive of said Miscellaneous
Maps with a line parallel with and distant Northerly
16 180.60 feet from the Northerly line of the land described
as Parcel 1 in the deed to Cecil H. McVay, et ux,
17 recorded January 13, 1959, in Book 4546, Page 11 of
Official Records• thence along said parallel line
18 South 83° 201 454 West 190.93 feet to the Westerly line
of the land described in Parcel 1 iti.the deed to

20 Southerly along said Westerly line to the most Northerly
corner of the land described in the deed to Bernard
21 Fink, at ux, recorded March 15, 1960, in Book 5146,
Page 337 of Official Records; thence South 10 061 0011
22 West 7.50 feet to a line parallel with and distant
Northerly 95.00 feet from said Northerly line to the land
23 of McVay; thence along said parallel line North 83°
201 45t1 East 203.29 feet to said Westerly boundary of
24 tract No. 3138; thence North 11° 191 141 West 85.28
feet to the point of beginning;

27 WHEREAS, it is to the interest of the City to accept
28 said grant of easement for such purposes;
29 NOW, THEREFORE, BE IT RESOLVED by the City Council of
30 the City of Newport Beach that said grant of easement be accepted
31 and the City Clerk is authorized and directed to execute and at-
32 tach a certificate of acceptance and consent to the recording of

said grant of easement in the County Recorder's office.
