HomeMy WebLinkAbout5325 - Harbor View AnnexWWComec 10/27/60 RESOLUTION N0, 5das- A RESOLUTION OF'THE CITY COUNCIL OF THE -CITY OF NEWPORT BEACH DECLARING ITS INTENTION TO ANNEX TO' THE CITY CERTAIN PROPERTY KNOWN AS FIRST ADDITION TO HARBOR VIEW ANNEX AND GIVING NOTICE THEREOF • WHEREAS, there is situated outside and contiguous to the City of Newport Beach a certain uninhabited territory within the meaning of the Annexation of Uninhabited Territory.Act of 1939, said territory being hereinafter more particularly described; and WHEREAS, annexation to the City would make municipal ser- vices available to the property owners and be for the best inter- ests of said owners and the City of Newport Beach and its citizens; and WHEREAS, on or about the 27th day of September, 1960, there was submitted to the Secretary of the Orange County Boundary Commission a legal description and plat of the hereinafter described uninhabited territory for its report pursuant to the provisions of Section 35002 of the Government Code of the State of California; and WHEREAS, on the 10th day of October, 1960, there was filed with the. City Clerk of the City of Newport Beach a report of said Orange County Boundary Commission pursuant to the provisions of Section 35002 of the Government Code of the State of California; and WHEREAS, the owners of all the territory to be annexed have filed written consent to the annexation with the City Council; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Newport Beach that proceedings are hereby initiated by the City of Newport Beach to annex the said territory hereinafter described, which territory is contiguous to the present.boundaries of said City and which said territory now is uninhabited within the meaning of the Annexation of Uninhabited Territory Act of 1939 and that the reasons for said annexation are that it would make municipal services available to the property owners and be in the best interests of said owners and the City of Newport Beach and its citizens that said City annex said territory° NOTICE IS HEREBY GIVEN that it is proposed by said City of Newport Beach to annex said hereinafter described territory.to said City, which said territory shall in these proceedings bear the name of "FIRST ADDITION TO HARBOR VIEW ANNEX ". The specific descrip- tion of the boundaries of the territory so proposed to be annexed is as follows- Beginning in the boundary of the city of Newport Beach at a point distant thereon S 63° 00' E 550 feet from the most Easterly corner of Tract 2202-per map recorded in Book 123, pages 22 et'seq., said Easterly corner being an angle point in said City Boundary and running thence N 27° 00' E 130 feet; thence S 63° 00' E 305 feet; thence -S 500 00' E 795 feet; thence S 720 00' W 245 feet; thence S 41° 30' W 350 feet; thence S 640 00' W 275 feet; thence S 77° 00' W 110 feet; thence S 46° 30' W 280 feet, more or less, to said City Boundary; thence N 320 34' 52" W along said Boundary 20 feet, more or less, to an angle point therein; thence N 370 05' 40" E along said Boundary 180 feet, more or less, to an_angl'e point therein; thence N 150 20' E along said Boundary 900 feet, more or less, to an angle point therein and the Southeasterly extension of fhe line previously described as S 63° 00' E; thence N 63° 00' W along said Boundary 270 feet to the point of beginning. FURTHER NOTICE IS HEREBY GIVEN that on Monday, the 12th day of December, 1960, at the hour of 7 -30 P. M. on said day, or as soon thereafter as the matter may be heard, in the Council Chamber of the City Hall of the City of Newport Beach, 3300 New- port Boulevard, Newport Beach, California, a hearing will be had, at which hearing the City Council shall hear and pass upon all written protests filed at any time before said hour set for said hearing by any person owning real property within the territory proposed to be annexed, and at any time before the hour set for said hearing any owner of property within the territory proposed to be annexed may file a written protest against the annexation. The protest shall set forth the name of the owner of the property affected and give a description of the said property in general terms. The City Clerk of the City of Newport Beach is hereby authorized and directed to cause a copy of this resolution to be 2. published once a week for two weeks, said publication to be com- plete at least twenty (20) days prior to the date set for the hearing, and the publication shall be in the Newport Harbor Ensign, • a newspaper of general circulation printed and published in the City of Newport Beach, and the GlAe'- Herald and Pilot, a newspaper of general circulation printed and published in the County of Orange and outside the City of Newport Beach. The City Clerk is further authorized and directed to mail a notice of the proposed annexation not less than twenty (20) days prior to the first public hearing on the proposed annexation to all persons to whom land proposed to be annexed is.-assessed in the last available equalized assessment roll, at the address shown thereon or as known to said City Clerk, and to any person who has filed his name and address and the designation of the lands in which he has any interest, either legal or equitable, with the City Clerk. 0 The City Clerk is further authorized and directed to transmit a certified copy of this resolution to the governing board of each school district which is included in whole or in part within the territory proposed to be annexed which has made written request therefor.
