A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH AUTHORIZING THE EXECUTION OF A
STIPULATION IN SUPERIOR COURT CASE NO. 70717
• WHEREAS, the City Council adopted Resolution No. 4597
authorizing and directing the City Attorney to take steps to inter-
vene in the Superior Court action entitled "County of Orange, Plain-
tiff, vs. State of California, et al, Defendants ", being No. 70717,
on the ground that said action affected title to certain tide and
submerged lands theretofore granted,to the City by the State of
California; and
WHEREAS, the City did file a complaint in intervention
asserting title to said tide and submerged lands; and
WHEREAS, the Board of Supervisors of Orange County have
now authorized the execution of a stipulation in said action under
which the County of Orange quitclaims to the City of Newport Beach
whatever right, title or interest, if any, said County may have in
said tidelands and submerged lands, the title of which was affected
by said action, and which authorizes the entry of a judgment declar-
ing that as between the County of Orange and the City of Newport
Beady and subject to all sovereign rights of the State of California,
the City of Newport Beach is the owner in trust of the following-
described tidelands, submerged lands, and filled lands within the
City.
Beginning at the intersection of a line drawn between
U. S. Bulkhead Station 107 and U. S. Bulkhead Station
106 as shown upon a'map dated December 26, 1950, on
file in the U. S. Engineers office, Los Angeles,
California, entitled "Harbor Lines, Newport Bay,
California ", and a line lying southwesterly of,
parallel to and distant 350.00 feet from the U. S.
Bulkhead Line between U. S. Bulkhead Station 106
and U; S. Bulkhead Station 105; thence southeasterly
• on said line to U. S. Bulkhead Station 106; thence
easterly on a direct line to the point of inter-
section of the southwesterly prolongation of the
northwesterly line of Heliotrope Avenue (formerly
34th Avenue) as shown upon a map of Corona Del Mar,
recorded in Map Book 3, Pages 41 and 429 Miscel-
laneous Maps, Records of Orange County, California,
and the line of ordinary high time of the Pacific
Ocean; thence easterly along said line of ordinary
high tide to an intersection with a line bearing South
20 West from the most westerly corner of Lot 121, as
shown upon a map of Tract No. 1116, recorded in'
Miscellaneous Maps Book 36, pages 19 and.,20, records
of said Orange County; thence South 20° West along
said line to its intersection with a line lying
southerly of, parallel to and distant 3 miles from
• said ordinary high tide line of the Pacific Ocean;
thence westerly along said parallel line to .its
intersection with a line that bears South 20 West
from the,point.of beginning; thence North 20° East
along said line to the point of beginning,
and which stipulation further provides that the action be dis-
missed as between the County of Orange and the City of Newport
Beach without prejudice except . as to the above - described lands;
and
WHEREAS, it would be in the best interests of the City
of Newport Beach -to execute said stipulation;
NOW, THEREFORE, BE IT RESOLVED that the City Attorney be
and he is hereby authorized and directed to execute said stipulation
on behalf of the City of Newport Beach.

the foregoing Resolution Noy 5349 was duly and
regularly adopted, passed, and approved by the City Council of
the City of Newport Beach, California, at a regular meeting of
said City Council held at the regular meeting place thereof, on
the 27th day of December 19 60 ,.by the following
