RESOLUTION NO, 3-V75'
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH DECLARING ITS INTENTION TO ANNEX TO
THE CITY CERTAIN PROPERTY KNOWN AS FIRST ADDITION
• TO SUPERIOR AVENUE ANNEX AND GIVING,NOTICE,THEREOF
WHEREAS, there is situated outside and contiguous to the
City of Newport Beach a certain uninhabited territory within the
meaning of the Annexation of Uninhabited Territory Act of 1939,
said territory being hereinafter more particularly.described; and
WHEREAS, the City has received a written petition request-
ing annexation of said territory containing a description thereof
and signed by the owners of not less than one-fourth of the land in
said territory by area and.by assessed value as shown on the last
equalized assessment roll of the County; and
WHEREAS, on or about the first day of September, 1961,

there was submitted to the Secretary of the Orange County Boundary
Commission a legal description and plat of the hereinafter described
uninhabited territory for its report pursuant to the provisions of
Section 35002 of the Government Code of the State of California; and -
WHEREAS, on the 11th day of September, 1961, there was
filed with the City Clerk of the City of Newport Beach a report of
said Orange County Boundary Commission prepared pursuant to the
provisions of Section 35002 of said Government Code; and
WHEREAS, the petitioners are the owners of all of the
territory to be annexed and by`their petition consent to such annex-
ation;
NOW; THEREFORE, BE IT RESOLVED by the City Council of the
City of Newport Beach that proceedings are hereby initiated to annex
said territory hereinafter described, which territory is contiguous
to the present boundaries of said City and which said territory now
is uninhabited within the meaning of the Annexation of Uninhabited
Territory Act of 1939 and that the reasons for said annexation are
that the _owners of all of said property have petitioned for its
annexation to the City of Newport Beach and it would make municipal
services available to said property owners and be in the best interests
of said.owners and the City and its citizens that said City annex
said territory.
NOTICE IS HEREBY GIVEN that it is proposed by said City
• of Newport Beach to annex said hereinafter described territory to
said City, which said territory shall in these proceedings bear the
name of "FIRST ADDITION TO SUPERIOR AVENUE ANNEX". The specific
description of the boundaries of the territory so proposed to be
annexed is as follows'-
That portion of Lot 169, Block 2 of Irvine's Subdivision as
shown on a map recorded in Book 1, page 88 of Miscellaneous
Maps, records of Orange County, California, and more
particularly described as follows;
Beginning at an angle point in the existing boundary line of
the City of Newport Beach, said angle point being in the
northwesterly line of the 60.00 feet in width right of way
as described in a deed to the State of California and
recorded in Book 683, page 248 of Official Records of said
Orange County, said angle point also being the most south-
erly corner of "the "Superior Avenue Annexation" as recorded
by City of Newport Beach- Ordinance No.. 820; thence N 50 ®14 °m
39" W 1090.00-feet-more-or .less along the city boundary as
shown by said "Suprior Avenue Annexation" to an angle point
in said city boundary, said angle point being in the north-
westerly right of way.line of Superior Avenue, 60.00 feet" in
width, and also in the southeasterly line of Lot 716 as shown
on a map of the "First Addition to Newport Mesa Tract" recorded
in. Miscellaneous'Map Book 8a pafe 61, records At Orange County,
California; thence S 3945 m35' W 843 feet more or less along
said northwesterly line of Superior' Avenue and along the south-
easterly lines of Lot 716 and Lot 717 of said tract and their
southwesterly extension to the intersection of the northwest-
erly extension of the southwesterly line of that portion of
Placentia Avenue, 60.00 feet wide, lying southeasterly. of
Superior Avenue as described in Book 2180, page 236, Official
Records of said Orange County; thence S 2232'-34" E 815
feet more or less along said southwesterly line of Placentia
Avenue and its northwesterly extension to a.point in the
northerly boundary line of the City of Newport Beach as shown
on "The Presbyterian Hospital of Orange County" annexation, as
per City Ordinance No. 558; thence S 89- 59 °m00E 800 feet more
or less along said city boundary line to an angle point in
said city boundary, and the northwesterly line of said 60.00
feet in width right of way deeded to the State of California;
thence northerly and northeasterly along said northwesterly
line and the boundary line of the City of Newport Beach as
shown on "Corporation Yard" annexation, as per City Ordinance
No. 617, 800.00 feet more or less to the point of beginning.
FURTHER NOTICE IS HEREBY GIVEN that on Monday, the 13 b�
day ofL�? e, .� J , 1961, at the hour of 7 -30 P. M. on said day,
or as soon thereafter as the matter may be heard, in the Council
Chamber of the City Hall of the City of Newport Beach, 3300 Newport

Boulevard, Newport Beach, California, a hearing will be had, at
which hearing the City Council shall hear and pass upon all written
protests filed at any time before said hour set for said hearing by
• any person owning real property within the territory proposed to be
annexed, and at any time before the hour set for said hearing any
owner of property within the territory proposed to be annexed may
file a written-protest against the annexation. The protest shall
set forth the name of the owner of the property affected and give a
description of the said property in general terms:
The City Clerk of the City of Newport Beach is hereby
authorized and directed to cause a copy of this resolution_to be
published once a week for two weeks, said publication to be complete
at least twenty (20) days prior to the date set for the hearing, and
the publication shall be in the official newspaper of the City.
The City Clerk is further authorized and directed to mail
a notice of the proposed annexation not less than twenty (20) days
prior to the first public hearing on the proposed annexation to all
persons to whom land proposed to be annexed is assessed in the last
available equalized assessment roll, at the address shown thereon
or as known to said City Clerk, and to any person who has filed his
name and address and the designation of the lands in which he has
Any interest, either legal or equitable, with the City Clerk.
The City Clerk is further authorized and directed to trans-
mit a certified copy of this resolution to the governing board of
each school district which is included in whole or in part within
the territory proposed to be annexed which has made written request
therefor.
