1 RESOLUTION NO. 5612
2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH AUTHORIZING THE EXECUTION OF A
3 CONTRACT WITH RESPLAN, INC. FOR THE CONSTRUCTION
OF A MATER LINE IN.DEL MAR VENUE

5 WHEREAS, in connection with the development of Tract No.
6 4444 and the service of water thereto, it is necessary for Resplan,
7 Inc., to install an 8 -inch water line and appurtenances within
8 the thirty feet of land for the southeasterly extension of Del Mar
9 Avenue heretofore dedicated by said company to the City; and
10 WHEREAS, it is in the public interest for a 12-inch water
11 line and appurtenances to be installed within said area to serve
12 said Tract N®. 4444 and to become a part of the City's water system;
13 and
14 WHEREAS, a contract has been prepared under which Resplan,
15 Inc., agrees to install such 12-inch water line and appurtenances
16 and the City agrees to pay the difference between the cost thereof
17 and the cost of installing an 8 -inch water line and appurtenances;
18 and
19 WHEREAS, the City Council has'considered the terms and
20 conditions of said contract and found them to be reasonable and
21 equitable and to the mutual advantage of the parties;
22 NOW, THEREFORE, BE IT RESOLVED that said contract be
23 approved, and the Mayor and City Clerk are hereby authorized and
24 1 directed to execute the same on behalf of tle City of Newport Beach.
