A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH ACCEPTING A GRANT OF EASEMENT
• WHEREAS, The Irvine Company, a West Virginia corporation,
has executed a grant of easement granting to the City of Newport
Beach a non - exclusive easement for the construction, reconstruction,
maintenance and repair of an underground pipeline for drainage pur-
poses in and along a strip of land, 6.00 feet in width, situated in
the City of Newport Beach, County of Orange, State of California,
described as follows:

That portion of Lot 1589 Block 53 of Irvine's Sub-
division as shown on a map reoorded in Book 1, page 88 of
Miscellaneous Record Maps in the office of the county
recorder of Orange County, California, described as follows:
The northerly 6.00 feet of Lot 54, Tract No. 4224 as
shown on a map recorded in Book 157, pages 1 to 14, inclus-
ive, of Miscellaneous Maps and the easterly extension of
said northerly 6.00 foot strip to the westerly line of
Newport Bay as shown on said map;.
WHEREAS, said grant of easement also recites as follows:
"RESERVING unto the Grantor, its successors and assigns,
the right to use said land for any purpose whatsoever as
shall not interfere with the use of said easement by the
Grantee, including but not limited to the right to construct,
relocate, repair and maintain driveways, surfaced areas,
docks, slips and sidewalks; provided however no building
shall be erected on said easement.
ALSO RESERVING unto the Grantor, its successors and as-
signs, the right to change the location of.said easement
upon the condition that the Grantor grants to the Grantee
herein an easement at another location for a storm drain of
adequate capacity upon the terms and conditions herein set
forth, and that the Grantor, its successors or assigns,
reconstructs or reimburses the Grantee for the cost of re-
construction of the pipeline installed within said easement
and its appurtenances in a manner that will continue the
usefulness and efficiency of said pipeline."
WHEREAS, it is to the interest of the City to accept said
grant of easement for such purposes;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach.that said grant of easement be accepted
and the City Clerk is authorized and directed to execute and attach
a certificate of acceptance and consent to the recording of said
grant of easement in the County Recorder's office.
ADOPTED this 11th day of September, 1962.
