2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH AUTHORIZING THE EXECUTION OF AN
3 AMENDMENT TO A SUBDIVISION AGREEMENT

5 WHEREAS, Pacific Electric Railway Company, as subdivider
6 Tract No. 4400, has agreed to install subdivision improvements in
7 accordance with an agreement dated the 11th day of February, 1962,
8 within one year from the date thereof; and
9 WHEREAS, said agreement provides that the City Council
10 may extend the time for performance by the subdivider under said
11 agreement if it determines that the circumstances justify such
12 extension of time; and
13 WHEREAS, the real property within Tract No. 4400 is under
14 condemnation by the State of California and said action has not been
15 completed; and
16 WHEREAS, an amendment to said subdivision agreement has
17 been prepared under which the time for completion of said improve-
18 ments would be extended to February 11, 1964, subject to the sub -
19 divider's making certain temporary improvements on Seashore Drive
20 as designated in said amendment; and
21 1 WHEREAS, the City Council has reviewed the terms of the
22 proposed amendment and found them to be acceptable;
23 NOW, THEREFORE, BE IT RESOLVED that the Mayor and City
24 Clerk be and are hereby authorized and directed to execute said
25 amendment on behalf of the City of Newport Beach,
26 ADOPTED this 26th day of November, 1962. )/
