RESOLUTION NO. 5779
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH APPROVING A FORM OF CARPORT RENTAL
• AGREEMENT FOR MARINAPARK
WHEREAS, there has been presented to the City Council of
the City of Newport Beach a form of carport rental agreement pro-
viding for the leasing of the carports and lockers in the City's
trailer park known as the Newport Marinapark,a copy of which agree-
ment is attached hereto, marked Exhibit "A ", and made a part, hereof;
and
WHEREAS, the City Council has reviewed said form and
found it acceptable and wishes to approve the same and to authorize
the City Manager or an employee of the City designated by the City
Manager to execute said agreements on behalf of the City;
NOW, THEREFORE, BE IT RESOLVED that the carport rental
agreement form attached hereto be and the same is hereby approved
and the City Manager or an employee designated by him be and each is
hereby authorized to execute agreements in such form on behalf of
the City as.lessor of the carports and lockers in said City -owned
Marinapark.

CARPORT RENTAL'AGREEMENT '
The City of Newport Beach, hereinafter referred tows
"LESSOR", does hereby lease to the undersigned lessee the carport
designated as Number together with the locker designated
as Number in the City BS trailer park known as "NEWPORT
MARINAPARR", for the term and at the rent, and upon the terms,
conditions and regulations as hereinafter set forth, to wits
1. LESSOR - MEANING. It is mutually understood by
the parties hereto, for the purposes of enforcement of the pro-
visions of this lease, the word "lessor" means the City Manager
of the City of Newport Beach, or his duly designated agent.
2. MAINTENANCE. Lessee agrees to maintain his car-
port and locker in a clean and orderly condition. No structural
alterations or improvements of any kind will be made by lessee to.
the leased premises without first obtaining written approval of
lessor. No highly inflammable substances or materials will be
stored in or on the leased premises.
3. RESPONSIBILITY. The lessor is not responsible for
any loss incurred by lessee due to fire, theft or accident.
4. ASSIGNMENTS AND SUBLEASES. Carports and lockers
are nontransferable without the consent of lessor.
5. TERM. The term of this lease is for the period of
commencing on the day of

6. RENT. During the term of this lease, lessee agrees
to pay to lessor as rental for said premises, the aggregate sum of
$ payable in equal monthly installments of $
per month, commencing on the day of 19 ,
and thereafter on the day of each month throughout the term
of this lease. Lessor acknowledges receipt of the sum of $
as rent for the first and last monthes rent of the term hereof.

7. TERMINATION. If lessee or any other occupant of
lessee's carport and /or locker fails to comply with any term,
covenant or condition as herein set forth, lessor shall have the
right to terminate this lease by first giving lessee three (3)
• days' written notice thereof. It is agreed that placing or post-
ing of any notice to lessee at any place upon the leased carport
space shall be equivalent to personal notice upon said lessee.
In the event it is necessary to engage the services of
an attorney to enforce any of the terms and /or conditions of this
agreement, lessee agrees to pay lessor reasonable attorney fees
and costs.
