RESOLUTION NO. 5813
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH REQUESTING THE STATE HIGHWAY
COMMISSION TO RECONSIDER ITS DECISION ADOPTING
THE ROUTE OF THE COASTAL FREEWAY FROM HIGHWAY
Ik 39 TO A POINT 2.2 MILES SOUTH OF MAC ARTHUR
BOULEVARD
WHEREAS, the State Highway Commission has adopted the
route of the coastal freeway from Highway 39 to a point 2,2 miles
south of MacArthur Boulevard in the location generally referred to
as the green line; and
WHEREAS, the construction of a freeway in this location
would not be in the best interests of the State of California,
would be destructive of unique properties along the route, and
would be contrary to the interests of the majority of the public
agencies to be served by the freeway;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that the State Highway Commission be
and is hereby urgently requested to reconsider its decision and
to reopen the question of the location of this portion of the
coastal freeway and to set a hearing to receive and consider
additional evidence regarding the route of this portion of the
coastal freeway. The reasons the City Council believes the Com-
mission should reconsider its decision are as follows:
1. All routes of the coastal freeway heretofore adopted
or now under consideration, except where influenced by topographi-
cal limitations, are approximately one mile inland from the Pacific
Ocean. There appears to be no valid reason to deviate from this
general alignment and distance from the shore line from Highway 39
through Newport Beach. For example, all routes under study immedi-
ately up coast from Highway 39 are approximately one mile inland.
• 2, The recommendation and report of the State Highway
Engineer to the Commission was not available for review by the
public agencies and interested parties prior to the date the
Commission actually adopted this freeway route. This procedure
made it impossible for the public.agencies to support the recom-
mendation of the State Highway Engineer by supplemental engineer-
ing, traffic and cost information. This procedure was a deviation
from the procedure normally followed by the Commission and was
done to accommodate the local agencies by fixing the route at the
earliest possible date. However, this procedural change did deny
the opportunity to evaluate the report and recommendation.
3. The Commission adopted the route contrary to the
recommendation of the State Highway Engineer and no official
written reasons of any State department, division, agency or
official have been made available to the public agencies or the
public either before or after the decision of the Commission. The
result of this was to deny an opportunity to the public agencies
and to the public to evaluate or challenge the validity of the rea-
sons that must have been the basis of the Commission's decision.
4. The State Highway Engineer has indicated in his
statement to the Commission that land costs along the green line
in West Newport have increased by three million dollars since the
initial estimates were made. The City Council believes that a
proportionate increase in land costs has occurred along the green
line all the way from West Newport to Newport Bay.
5. Interchanges on the green line in addition to those
considered in preparation of the original cost estimates will be
required to properly serve traffic needs. Costs of these inter-
changes were not included in the cost information upon which the
Commission based its decision. These additional costs added to
the more realistic estimate of land costs make the green line
economically unfeasible when compared with the same costs on the
inland route recommended by the State Highway Engineer.
