2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH REQUESTING THAT THE JUDGES OF THE
3 MUNICIPAL COURT OF.THE NEWPORT BEACH .JUDICIAL
DISTRICT INCREASE THE BAIL FOR OVERTIME PARKING
4 VIOLATIONS AND FOR ABANDONING A VEHICLE ON A
5i PUBLIC . STREET .WITHIN. THE CITY OF NEWPORT BEACH
6�I WHEREAS, Section 3289 of the Newport Beach Municipal Code
7i provides that it is unlawful for any person to park a vehicle
8I between the hours of 8:00 a.m. and 6:00 p.m. of any day for periods
9 of time longer than one hour or two hours, or for different hours
10l or days, upon such streets or portions thereof as the City Council
11 shall designate by resolution; and
12I WHEREAS, Section 3291.6 of the Newport Beach Municipal
13 Code provides that it is unlawful for any person to park a vehicle
14 or to allow a vehicle to remain parked in any parking space in a
15 parking meter zone during any time when the parking meter adjacent
16 to such parking space indicates that the time shown on the meter
17 has expired or beyond the time parking in such space is otherwise
18 permitted or limited; and
19 WHEREAS, Section 3265 of the Newport Beach Municipal Code
20 provides that it is unlawful for any person to park a vehicle upon
21 any street or alley for a period of 72 or more consecutive hours;
22 WHEREAS, at present the bail schedule approved by the
23 Judges of the Municipal Court of the Newport Beach Judicial Distric
24 provides that the bail required for violations of said Section 3289
25 shall be one dollar or two dollars, depending upon the area in
26 which the violation occurred, and that the bail required for viola -
27 tions of said Sections 3291.6 and 3265 shall be one dollar; and
28 WHEREAS, in the judgment of the City Council the present
29, bail of one dollar for each of said violations is inadequate; and
30 WHEREAS, the City Council after studying the matter has
31 determined that it would be desirable that the bail for overtime
32 parking violations under Section 3289 for which the bail is one

dollar at present and the bail for overtime parking meter violations
be increased in order to deter such violations and to encourage the
payment of parking meter fees and that the bail for abandoning a
vehicle on a public street be increased in view of the cost of
enforcement;
NOW, THEREFORE, BE IT RESOLVED that the Judges of the
Newport Beach Municipal Court are respectfully requested to change
the Bail Schedule so as to provide for an increased bail of two
dollars for overtime parking violations under Section 3289 for which
the bail is one dollar at present, an increased bail of two dollars
for overtime parking meter violations, and an increased bail of five
dollars for the offense of abandoning a vehicle on a public street
within the City of Newport Beach.
ADOPTED this 23rd day of November., 1964.
