RESOLUTION NO.6435
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH CALLING A SPECIAL MUNICIPAL ELECTION
TO BE HELD IN SAID CITY ON THE 8TH DAY OF NOVEMBER,
19669 FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED
ELECTORS OF THE CITY A PROPOSED CHARTER AMENDMENT TO
ADD SECTION 1402(e) TO THE CITY CHARTER, AND REQUEST-
ING THE BOARD OF SUPERVISORS OF ORANGE COUNTY TO
CONSOLIDATE SAID SPECIAL MUNICIPAL ELECTION WITH THE
STATEWIDE GENERAL ELECTION TO BE HELD ON SAID DATE
AND TO CANVASS THE RETURNS THEREON
WHEREAS, a statewide general election is to be held on
November 8, 1966; and
WHEREAS, it appears to be in the best interests of the
City for the City Council to call a special municipal election
for the purpose of submitting to the qualified electors a proposed
charter amendment which would authorize the City Council to sell
and convey a certain parcel of City -owned waterfront property as
hereinafter described, free of the restriction on the sale of
such property as set forth in Section 1402 of the City Charter
which prohibits the City Council from selling or conveying any
waterfront or beach property, excepting to the State or to the
County for use as a public beach or park, and to request that
said special municipal election be consolidated with said general
election;
NOW, THEREFORE, the City Council of the City of Newport
Beach does hereby resolve, order and request as. follows:
SECTION 1. A special municipal election is hereby
called and shall be held on Tuesday, November 8, 1966, for the
purpose of submitting to the qualified electors a proposed charter
amendment to add Section 1402(e) to the City Charter. Pursuant
to the terms of Section 23302 of the Elections Code of the State

PROPOSED CHARTER AMENDMENT:
Shall the Charter be amended to add Section 1402(e)
to permit the City Council to sell and convey that

lying easterly of Newport Boulevard and southerly
of 26th Street, being a portion of Lot 2 in Section
33, Township 6 South, Range 10 West, of the San
Bernardino meridian, lying northeasterly of the
northeasterly line of Blocks 222 and 223 in Section

page 21, of Miscellaneous Maps, Records of Orange
County, California?
A cross ( +) placed in the voting square after the word
"YES" as set out above shall be counted in favor of the adoption
of the proposed charter amendment.
A cross ( +) placed in the voting square after the word
"NO" as set out above shall be counted against the adoption of
the proposed charter amendment.
Should the proposed charter amendment receive a favor-
able vote and be approved, Section 1402(e) shall be added to
the Charter to read as follows:
"Section 1402(e). Exception to Section 1402.
Notwithstanding the provisions of Section 1402, the
City Council may sell and convey that parcel of City -
owned property fronting on Newport Bay described as
follows:
That portion of Lot 2 in Section 33, Township 6
South, Range 10 West, of the San Bernardino
meridian, in the City of Newport Beach, County
of Orange, State of California, according to
the official plat of said land filed in the
District Land Office, August 4, 1890, lying
northeasterly of the northeasterly line of
Blocks 222 and 223 in Section A, Newport Beach,
as per map recorded in Book 4, page 21, of
Miscellaneous Maps, in the office of the County

Recorder of said County and between the northeasterly
prolongations of the northwesterly line of Lot 1 in
Block 223 of said Tract and of the northwesterly
line of Lot 1 of Tract No. 814, as per map recorded
in Book 24, pages 35 and 36, of said Miscellaneous
Maps.n
` SECTION 2. The Board of Supervisors is hereby requested
to canvass the returns of said special municipal election, and
said election shall be held in all respects as if there were only
one election and only one form of ballot shall be used.
SECTION 3. The precincts, polling places, election
officers and hours for the polls to be open shall be the same
as those established and announced by the Board of Supervisors
for the general election to be held on the same date.
SECTION 4. The City Clerk is authorized and directed
to file a certified copy of this resolution with the Board of
Supervisors and with the County Clerk, to publish notice of
said election, to publish a synopsis of the measure to be voted
on at least twice before the date of said election, to publish
the entire text of the proposed charter amendment not less than
40 nor more than 60 days before the date of said election, to
fix a date after which no arguments for or against the measure
to be voted on may be submitted, to receive and prepare for
distribution an argument for and an argument against such
measure, to assist and cooperate with the County Clerk with
respect to the special municipal election, and to perform such
other acts as are necessary to present the measure to the quali-
fied electors,

Beach, California, do hereby certify that according to the records of the
City of Newport Beach filed and maintained in my office, the foregoing
Resolution No. 6435 was duly and regularly adopted,
passed, and approved by the City Council of the City of Newport
Beach, California, at a regular meeting of said City Council held at the
regular meeting place thereof, on the 22nd day of August
1966, by the following vote, to wit:

Forgit, Shelton
