A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH DECLARING ITS INTENTION TO GRANT
TWO FRANCHISES FOR THE OPERATION OF COMMUNITY
ANTENNA TELEVISION SYSTEMS WITHIN THE CITY OF
NEWPORT BEACH
WHEREAS, the City Council has received applications from
Warner Bros. TV Services, Inc., and Community Cablevision Company
for franchises to construct and operate community antenna television
systems within the City of Newport Beach; and
WHEREAS, said applications have been reviewed by the City
Council and determined to be in compliance with the requirements
set forth in Chapter 5.44 of Title 5 of the Newport Beach Municipal
Code entitled "Community Antenna Television "; and
WHEREAS, it is the intention of the City Council to con-
sider granting to Warner Bros. TV Services, Inc., a City -wide
nonexclusive franchise for the construction and operation of a
community antenna television system for a term of not less than
ten (10) years nor more than twenty (20) years, subject to
the payment by the applicant of an acceptance fee to be determined
by the City Council and subject to an annual franchise fee of at
least three percent (3 %) of the gross receipts of the applicant
derived from subscribers within the City; and
WHEREAS, it is the intention of the City Council to con-
sider granting to Community Cablevision Company a nonexclusive
franchise for the construction and operation of a community
antenna television system to provide community antenna television
service to a proposed service area described generally as the
area within the City of Newport Beach bounded on the west by Jam-
boree Road, on the south by East Coast Highway to its intersection
with MacArthur Boulevard and by Fifth Avenue to the easterly city
limits, and on the east by the easterly city limits, for a term of
not less than ten (10) years nor more than twenty (20) years,
subject to the payment by the applicant of an acceptance fee to be
determined by the City Council and subject to an annual franchise
fee of at least three percent (39,) of the gross receipts of the
applicant derived from subscribers within the City;
NOW, THEREFORE, BE IT RESOLVED as follows.
1. A public hearing shall be held on December 12, 1966,
at 7 :30 P.M. in the City Council Chambers, City Hall, 3300 West
Newport Boulevard, Newport Beach, California, at which time any
person representing the applicants for said franchises or having
any objection to the granting thereof may appear before the City
Council and be heard thereon.
2. At said public hearing the City Council shall
proceed to hear any interested persons wishing to be heard, shall
pass upon all protests or objections to the granting of said fran-
chises, and its decision thereon shall be final and conclusive.
Thereafter, it may by ordinance grant said franchises.
3. The franchise applications shall be available for
inspection by any interested person at the office of the City
,Clerk located in the City Hall, 3300 West Newport Boulevard,
Newport Beach, California.
4. The City Clerk is directed to publish this resolu-
tion at least once within fifteen (15) days of its passage and
at least ten (10) days prior to the date set for said public
hearing in the official newspaper of the City.
