A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH DENYING ALL PROTESTS TO.A PROPOSED
IMPROVEMENT CONSISTING OF THE INSTALLATION OF
ADDITIONAL STREET LIGHTS AND APPURTENANCES IN
ASSESSMENT DISTRICT NO. 50 (BALBOA ISLAND STREET
LIGHTING DISTRICT) PURSUANT-TO THE PROVISIONS OF
THE STREET-LIGHTING ACT OF 1919, ORDERING.THAT
THE PROPOSED IMPROVEMENT BE MADE, AND DETERMINING
T;'AT THE REQUIREMENT FOR PUBLIC BIDS _SHALT. BE WAIVED
WHEREAS, on the 13th day of November, 1967, the City
Council adopted Resolution No, 6667 declaring its intention to
order an improvement consisting of the installation of 25 incan-
descent street lights and appurtenances in the alleys of Balboa
Island in the City of Newport Beach in accordance with the pre -
liminary report filed by the Public Works Director with the City
Clerk and approved by the City Council on the 23rd day of October,
1967; and
WHEREAS, said Resolution No. 6667 provided that Monday,
the 11th day of December, 1967, at the hour of 7 :30 P.M. was set as
the day and hour when all interested persons having filed a written
protest may appear at the Chambers of the City Council and show
cause why the City Council should not order the proposed improvemen
to proceed; and
WHEREAS, notice of said protest hearing was duly given by
11, posting and publication in accordance with the notice requirements
set forth in the Street Lighting Act of 1919, Division 14, Part 1
of the Streets and Highways Code of the State of California; and
WHEREAS, at the time appointed therefor the City Council
I heard and considered all protests by persons objecting to the pro-
posed improvement or the assessment therefor;
NOW, THEREFORE, the City Council of the City of Newport
Beach does hereby find, resolve and order as follows:
1. That all protests or objections to the proposed
improvement are denied.

ill 2. That the proposed assessment as shown in the pre -
21 liminary report of the Public Works Director is confirmed.
3I 3. That it is ordered that the proposed improvement
4I shall be made.
5 4. That the improvement shall be for a period of
61 eighteen (18) years, commencing on January 1, 1968, and ending on
7 December 1, 1985.
81 5. That the City Council hereby determines that the
9 alternative procedure for levying and collecting assessments on an
10 ad valorem basis pursuant to Chapter 8.5, Part 1, Division 14 of
ll the Streets and Highways Code shall be followed.
12 6. That the boundaries of the assessment district
13I shall remain identical with the boundaries of Assessment District
14) No. 50 as said district was originally established, as shown on
15 that certain map, entitled "Street Lighting Assessment District on
16 Balboa Island ", Drawing No. E- 4992 -S, which is designated Exhibit
17 "A -1" and attached to the preliminary report of the Public Works
18 Director and to Resolution of Intention No, 6667,
19 71 That the estimated cost of the improvement for the
20 first fiscal year, ending on June 30, 1968, is $675.
21j That said estimated cost shall be paid by special
22 assessment taxes levied upon all the lands, exclusive of improve -
23, ments, within the district, except that if any lots or parcels of
24 1 land owned by the City of Newport Beach are included within the
251 assessment district, all of such land shall be omitted from the
26 assessment hereafter to be made to cover the costs of said improv
27 went.
28 91 That pursuant to Section 18171 of the Streets and
29 Highways Code, the City Council hereby finds and determines that
30 there is only one contractor, namely, the Southern California
31I Edison Company, that is practically capable of serving the street
32 lighting system to be installed in accordance with the plans and

specifications contained in the preliminary report of the Public
Works Director and that such contractor is subject to the juris-
diction of the Public Utilities Commission of the State of Cali-
fornia. Therefore, the City Council hereby waives the requirement
of competitive bidding and orders the improvement to be carried
out by the Southern California Edison Company in accordance with
rates and rules filed by it from time to time with said Public
Utilities Commission.
10. That the City Clerk is directed to file a certified
copy of this resolution and the map of the district hereinabove
referred to with the Tax Assessor of Orange County and with the
State Board of Equalization.
ADOPTED this 11th day of December, 1967.

City of Newport Beach, California, at a regular meeting of said City Council
held at the regular meeting place thereof, on the 11th day of December 1967,
by the following vote, to wit:
