TITLE: Resolution Supporting Submission of Grant Applications under the
Orange County Transportation Authority (OCTA) Measure M2
Environmental Cleanup Grant Program
ABSTRACT:
Staff plans on submitting several applications to obtain funding to construct various
water quality improvement projects. The applications require the City Council to adopt a
resolution endorsing the grant applications.
RECOMMENDATION:
Adopt Resolution No. 2013 -36 authorizing and supporting submission of grant
applications for OCTA Measure M2 Environmental Cleanup Tier 1 and Tier 2, grant
programs.
FUNDING REQUIREMENTS:
The Tier 1 grant applications will request approximately $500,000. Should the City be
successful and awarded the full amount, the City's minimum match requirement will be
25% or approximately $125,000. The match would be met through in -lieu contributions,
e.g. staff inspection, maintenance and the Tidelands Fund. The Tidelands Fund dollar
amount is estimated at $75,000 and would be appropriated with the adoption of a future
Capital Improvement Program budget or at the time of a contract award to perform the
work.
The Tier 2 grant applications will request approximately $2,000,000. Should the City be
successful and awarded the full amount, the City's minimum match requirement will be

between 25 % -50% or approximately $500,000 - $1,000,000. The match will be met
through in -lieu contributions, e.g. staff inspection, maintenance and the Tidelands Fund.
The Tidelands Fund dollar amount is estimated at $375,000 - $750,000 and would be
appropriated with the adoption of a future Capital Improvement Program budget or at
the time of a contract award to perform the work.
DISCUSSION:
OCTA has established and is administrating an environmental cleanup grant funding
program to address water quality degradation associated with transportation- generated
pollution as a component of Measure M2. Measure M2 is a half -cent sales tax for
transportation improvements approved by Orange County voters in 2006.
For the Tier 1 grant program, a total of $19.5 million is projected to be available over a
seven -year period that began in FY11/12. Approximately $2.8 million is available to be
awarded with this grant "Call for Projects." Staff plans to submit several applications
under this Call for Projects that will be used to install trash collecting devices and
irrigation retrofits. Trash collecting devices, Continuous Deflective Separation (CDS)
units and trash and debris booms, will capture and remove trash and debris from the
storm drain system and the Bay. Irrigation retrofit projects will target various street
medians (e.g. Jamboree Road. and San Joaquin Hills Road).
For the Tier 2 grant program, a total of $38.5 million is projected to be available over a
two -year period beginning in FY12/13. Approximately $25 million is available to be
awarded with this grant "Call for Projects." Staff plans to submit several applications
under this Call for Projects that will be used for dredging, storm drain to sewer
diversions and installing sediment /erosion controls. Proposed projects include dredging
the Semeniuk Slough, diverting the "Arches" storm drain and installing sediment /erosion
controls within the Upper Newport Bay. Note: detailed eligibility and grant submittal
requirements will be released by OCTA later this summer.
As required by the grant application, an adopted resolution must be submitted with the
applications stating that the 1) City Council has reviewed and supports the applications,
2) City is capable of providing the required match funding and /or in -kind contributions,
projects and 3) City agrees to work with OCTA to meet established deadlines. If
awarded a grant, the City Council will be asked to accept the grant funds at a future
meeting date.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will
not result in a direct or reasonably foreseeable indirect physical change in the
environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378)
of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it

Itas no potential for resulting in physical change to the environment, directly or
indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).

RESOLUTION NO. 2013
A RESOLUTION OF THE CITY COUNCIL. OF THE CITY OF NEWPORT
BEACH AUTHORIZING AND SUPPORTING THE SUBMISSION OF A
GRANT PROPOSAL FOR FUNDING UNDER THE ORANGE COUNTY
TRANSPORTATION AUTHORITY (OCTA) ENVIRONMENTAL.
CLEANUP, TIER 1 AND TIER 2 GRANT PROGRAM.
WHEREAS, the Orange County Local Transportation Ordinance No. 3, dated
July 24, 2006, known and cited as the Renewed Measure M Transportation Ordinance
and Investment Plan, has announced funding available through the Environmental
Cleanup Program to help protect Orange County beaches and waterways from
transportation generated pollution (urban runoff) and improve overall water quality; and
WHEREAS, the Environmental Cleanup, Tier 1 Grant Program consists of
funding to purchase and install catch basin Best Management Practices (BMPs), such
as screens, filters, inserts, trash collection devices and other "street- scale" low flow
diversion projects; and
WHEREAS, the Environmental Cleanup, Tier 2 Grant Program consists of
funding to purchase and install large scale BMPs, such as trash collection devices,
constructive wetlands, infiltration basins and low flow diversion projects; and
WHEREAS, the Orange County Transportation Authority has established the
procedures and criteria for reviewing proposals; and
WHEREAS, the City of Newport Beach has developed a targeted program to
reduce transportation generated pollution and improve water quality;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF NEWPORT
BEACH DOES RESOLVE AS FOLLOWS:
Section 1. The City Council has reviewed and supports the proposal, and
hereby authorizes the City Manager or his designee to submit the proposal.

Section 2.. The City of Newport Beach is capable. of providing the @1Tiou1-11 oi:
funding and/of- in -kind contrlbUtlonS, specified in the funding plan and agrees to provide
necessary funding and /or in -kind contributions if awarded a grant.
Section 3. If awarded a grant, the City COLInGil (at a future meeting) will decide
to accept the funds and work with OCTA to meet established deadlines.
Section 4. This resolution shall become effective immediately upon its passage
and adoption.
