Honorable Mayor Curry, and City Council Members,
We appeal to all Members of the City Council to hear us, understand our needs and view the areas in question should you
wish. Some Council Members may not be familiar with the service road, the two (2) loading docks as they are presently
functioning, the buildings foot prints, proximity to condominiums, completion of sound wall or lack off wall, and of
course the landscaped areas along Service road.
We must be proactive in our endeavor to live in a quiet environment.
Hoag cannot blindly ignore our pleas and requests for improvements, changes, modifications on the Dietary loading dock
as we have repeatedly communicated to them since 2011 and most recently at our Board Meeting March 19, 2013.
Hoag has looked at the Dietary loading dock matters in a myopic view, or through long heavy lenses. The Dietary loading
dock violations have always been ignored; as a result this propels all of the affected residents near proximity of the
Dietary loading dock, 260 Cagney Lane at Villa Balboa to be vigilant and take steps to protect our surroundings, and our
sanity! It is evident that the Primary loading dock has always been a priority, while the Dietary loading dock has been
overlooked for several years. One cannot compare the difference between the two (2) loading docks. We have monitored
"The "Primary" loading dock, on average it is 80% quiet, the only exception of a worker using the compactor to flatten
cardboard boxes, that being well enclosed /protected is not a noise issue per se, trash compactor exchange, deliveries, this
loading dock is not heavily busy with big trucks and the few who backup toward the loading dock landing have plenty of
room to maneuver and are far away from the sound wall and 280 bldg. Its location and space for parking is excellent,
whereas the "Dietary" location is cramped /small/ and faced daily with heavy truck deliveries, close proximity to our slope
and 260 Cagney lane bldg. We have yet to understand why this small loading dock has been chosen as the Main loading
dock for all the many deliveries it receives based on the foot prints of the building and surroundings instead of the Primary
loading dock. We are disappointed that our City Council Members supported Hoag request usage and the imbalance
between the two (2) docks activities and building foot prints.
As a 27 years owner/ resident of a condominium at Villa Balboa, I amongst others are most aware of Hoag growth,
development and success. We appreciate Hoag presence, we do not deny that. The fact that Hoag is a successful hospital,
does not remove them from creating hiccups, and disenchantments with us. We are all familiar with growing pains, they
will always surface, and unfortunately often the neighborhoods pay a price.

At such, on behalf of the residents of the 260 Cagney Building, at Villa Balboa, I would like to present to the Council
members the followings matters residents from the 260 Building have shared with me regarding the continued noise
violations in particular from the Service Road below our homes, & the Dietary loading dock. Failure from Hoag staff to
enforce the rules, as well as abiding to the regular hours as specified in original agreements keeps on growing. These
continued issues are affecting all of us, as well as the value of our properties. Homes do not sell due to negative comments
from prospective buyers are often heard and the same is heard, "Who wants to listen to the noise, look at the mess down
below "and pay from $2800 a month or more. Some Owners left their homes and moved to other areas, leasing a home
instead in a quiet neighborhood. Often the condo remains empty. In some cases, condominiums locations at 260 -280 bldgs
are not always easy to lease or sell due to Service road/Dietary issues.
You will find a two (2) page "Schedule of events" "Noise disturbances" from October 2012 to April 20, 2013 as well as
pictures as true proof of when activities took place.
The Staff Report became available on Friday, April 19, 2013, at which time I downloaded it, printed and reviewed with
others.
After reading the 71 page report from Hoag Memorial Hospital Presbyterian "Development Agreement No.5- Annual
Compliance Review 2013 dated March 19, 2013, we realized that we are not in total agreement with Hoag on several
issues listed on the presented Agreement, these will be listed on separate document.
Each year Hoag Hospital staff presents our Home Owners Association (Villa Balboa) with Updates in regards to
"Previous agreements/changes" as requested by City of Newport Beach , and each year we share with Hoag' staff the
issues of concern. In 2011 City Council Members received a detailed 8 page report with photos as submitted by me
regarding Service road/loading dock noise issues, nothing changed the following year in 2012, and now in 2013 we have
not seen changes, other than the fact that the construction trailers have finally been removed from service road below our
slope, along with Port a Potty and workers are gone. For that matter noise has increased drastically along service road and
Dietary loading dock. This year, Hoag gave us their "Update" on March 19, 2013 at our regular Board Meeting; at that
time I shared our concerns for noise violations, as well as speeding vehicles not respecting the IOmph limit on Service
road. Since Hoag created the access road from Pacific Coast Highway to Hoag Drive, the road off PCH toward Child Care
center, Cancer Center and up toward the Service road, became a "short cut" used by drivers. Traffic at least tripled and
speed followed. Since this is a Private road, it is never monitored by NBPD, therefore I requested at our Meeting on
March 19, 2013 that speed bumps be installed along the road starting at the Primary loading dock ending on Service road
toward Hospital Road. It is our hope that speed bumps would deter speeding fanatics and reduce traffic on Service road.
I am pleased to note that Hoag is considering this request, (see page 2 of their agreement addressing our concern) they
have however noted adding speed Humps. I believe that speed bumps while reducing vehicle speeds, the noise from
having these may increase, particularly if trucks use the route regularly. Since I am not an expert on speed bumps or
Humps I will not confirm either or. For your information: Two (2) Speed Bumps were installed on Hoag drive, near
Child Care Center, Cancer center; these definitely slow the vehicles traveling up to the Stop sign. Unfortunately once
drivers make a left and reach Service road, said road becomes an open race track We feel that at this stage Hoag
consideration of speed bumps or humps should not be an option, . It must become a reality for Safety and noise
reduction on that road.
I will conclude in thanking the City Council Members for taking the time to read and review the attached documents as
presented prior to the City Council meeting, April 23, 2013 — 7:00 PM , give us consideration of our concerns prior to
granting Hoag "Good Faith" compliance on all matters.

down the service road toward the 280 bldg.- 7:14PM vehicle came up service road toward Hospital road- 7:15PM a black
vehicle came down from Hospital road toward the 280 bldg at such a speed I could not make out the make /model of the
car- Speed at least 35 it actually scared me.
7:18PM another vehicle came down Hospital road again toward 280 bldg. 7:20PM gate was finally closed, and security
vehicle drove down toward end by 280 bldg to close gate which I heard by being slammed so hard.
Sunday, March 21, 2013 — EVENING- Dietary loading dock activities —3 vehicles in loading dock- One vehicle came in @
about 7:08PM, another approx... 7:15PM, the 3rd truck few minutes later. Workers were removing items from vehicles,
disposing of items in trash compactor bin within the dock, washing also took place. One truck that had entered the
loading area had backed all the way to the landing, driver left his lights on bright on vehicle the entire time he was there.
Gradually one vehicle after the others left the loading dock. I took a sound meter reading from our slope above the
loading dock the reading on meter was 74dB ( Bear in mind that it is not easy to take picture with IPhone, holding a
sound meter at the same time & hanging onto shrubs on a steep slope) . Gradually all vehicles left, all made a left turn
from loading dock down the service road, meaning they all drove down just below our windows. Then the loading dock
worker backed his vehicle into the loading dock, only his smaller vehicle is now left inside. At 20:17 PM the worker
walked toward the enclosed fenced area where the dumpster /trash /storage, equipment area etc...) He unlocks the
heavy chain to open the locked gate (the dropping of the metal chain on ground was heard, he then proceeded with his
flashlight to look for something inside that area, he was there for a few minutes, then went back toward loading dock
and inside the building. Please note that all along after 7:08PM, regular vehicles came down or up the Hospital Service
road since both gates were still opened. Both gates remained opened during all that time, at 9:06PM; I got chilly, came

back up and went inside. I never heard the gate closed and would have because I always leave my sliding doors open.

Friday, March 22, 2013 — 9:03 AM- Dietary loading dock - 40 to 50 Ft. SYSCO truck exit loading dock and parks along
fenced area, exit his truck from passenger side since he is parked so close to fence, leave engine running and leaves
truck, vehicle idled for at least 5 minutes or more, Sound meter reading as shown 78 dB (See pictures attached, No
idling sign picture as well) As soon as Sysco pulled out more trucks entered the Dietary loading dock- of course all with
backing alarms, at one point I had a Meter reading of 84dB between Sysco truck, other trucks entering the loading dock,
not fast enough to get the picture on sound meter. (Sorry)- (See attached picture for that day) .

Service road- below our slope- (see attached picture)
Saturday, April 6, 2012 - Noise- Dietary loading dock- We had noise all day long and evening - First the gate did not
close @ 7:OOPM —Then from 8:30PM on to 9:45PM I kept hearing noise from inside Dietary loading dock, again, metal,
against metal, things being moved around, more washing, possibly carts or tables from Cafeteria or others, I was
reluctant to go down having some legs discomfort, so I was patient, when I no longer could stand it, I finally went down
@ 9:45PM to take pictures hanging on to the slopes, hoping no coyotes were around, unfortunately the worker had
gone inside and no one else was around the loading dock, all was calm later on.
Friday April 19, 2013 - Same Dietary loading dock activity all day long & into evening- Gate did not close until 8:05 PM
Saturday mornina April 20, 2013- Vehicles came down the service road from Hospital road and lined up first one was
there before 6:30AM — I was there at 6:30 AM (See attached pictures taken at 6:41 & 6:46AM) Next truck right behind -
At 6:50 one vehicle started to move forward at 6:55 one female staff came down from upper level road by emergency
exit and opened the gate, vehicles proceeded to loading dock backing in, backing in one after the others, backing alarm
at full level of course, and the cacophony continued all day. What a pleasure to have to listen to all of these vehicles
early on a Saturday morning. !!!
This will end the recapitulation of said noise disturbances from Dietary loading dock as witnessed and recorded.

sound meter reading, at one point it was 74 db- (Hard to take picture with (phone, Sounder meter, hanging on to shrubs
in a steep slope). Later lone worker walked to fenced area, approx... 8:17PM — (dumpsters /storage of trash /equipment). I
heard the locking chain dropped, worker opened the gate, went into fenced area with his flashlight, (picture is printed
as well), there for few minutes, then went back in loading dock and inside bldg. All along after 7:0813M, regular vehicles
came down from Hospital road down service road since both gates were opened. The gate remained opened, at 9:06PM
I got chilly and came back up.

READING /CONCERNS /COMMENTS
IN READING HOAG AGREEMENT AS PRESENTED TO CITY COUNCIL MEMBERS I WOULD LIKE TO REVIEW THE FOLLOWING
MATTERS:
TRASH COMPATORS - Comments are covered in Hoag Agreement proposal for the Primary loading dock as a follow up
from previous agreement regarding certain matters.
THE DIETARY LOADING DOCK TRASH COMPACTOR IS NOT AT ALL MENTIONED AND NEVER WAS. CAN IT BE
ADDRESSED AND CONSIDERED FOR MODIFICATION /IMPROVEMENTS IF DOABLE? This compactor is located partially
outside the walls of the loading dock and often after 7:OOPM we hear a lot of noise coming from that location. I do not
believe that sound absorbing panels were even considered or are even present inside this loading dock which is why
every time a worker moves equipment/ metal tables or carts the sounds are bouncing on the walls in that small
enclosures inside this loading dock.
Loading dock activities noise levels are regulated by Hoag Hospital (page 14)- Acoustical measurements test reports —
Noise level from loading dock are not to exceed 65db during the day time 7:OOAM to IOPM — In our case the noise level,
dB reading has been well above the 65clB when activities are in progress (no trucks inside ) Please note that the Primary
loading dock is closed during the nighttime hours as opposed to the Dietary loading dock hours around the clock.
Dietary loading dock noise level & activity were done February 26, 2013- Measurements test reports, (page 19),
measurements of noise levels shows levels 64.8 dB ,noise levels satisfy 65dB maximum allowable noise level
requirement of the Planned Community test. On that date I show no Noise reports violations either, no complaints from
anyone.
Compactor bin — No noise reported as well. Quiet day indeed.
Regarding the compactor Bin removal- A 7:00 AM , truck is scheduled to arrive at Dietary dock to remove, empty off site
and replace on specific days, we very seldom have a meter reading of 65 dB during day time hours from that area. The
noise level can vary between 68 to 74 dB. Night time noise is very minimal from midnight on, only a couple of times did
we have problems very late at night.
Again all noise level measurements done by Hoag were taken away from the 260 bld. From our location 260 bldg, we
have hardly if ever had a 48 or 55 dB noise reading from activities of Dietary loading dock.
Mechanical equipment: We do hear the noise coming from Upper service road at times more than others, it's a
constant humming.
Kitchen exhaust: For some reasons since work was done on roof /equipment improvement, done across from us the 260
bldg we often get Food odors from 6:00 AM on, meaning breakfast preparation, lunch and dinner. Needless to say it is
not very pleasing at 6:00 AM. While the kitchen equipment might be enclosed, possibly the lovers have been changed.
Could this be checked?
GATES CLOSURE: Service road- upper and lower —Can these gates be closed on time daily, can the STAFF PLEASE NOT
SLAM THEM SHUT, BUT GENTLY. METAL HITTING METAL CAN BE HEARD IN ALL UNITS FACING SERVICE ROAD AND
OTHERS FACING TENNIS COURTS.
Construction equipment on Service road: All has been removed — The only remaining item, not only an eye sore, but
very noisy area is the enclosed fence containing a large dumpster and other items. We have looked at this fence and
dumpster there one after the others, at times full of debris for over 3 weeks, for almost 3 years. Prompt removal will be
appreciated so that all residents facing Service road from unit 260 toward 280 can enjoy, clean space, and parking
spaces.
