A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH OBJECTING IN PART TO THE ANNEXATION
OF CERTAIN TERRITORY KNOWN AS BACK BAY ANNEXATION
NO. 1 TO, THE CITY OF COSTA MRSA
WHEREAS, an application for annexation of a parcel of
• land to the City of Costa Mesa has been submitted to the County of
Orange Local Agency Formation Commission by the City of Costa Mesa; and
WHEREAS, the area proposed to be annexed by the City of
Costa Mesa lies contiguous to the City of Costa Mesa, the easterly
boundary of which proposed annexation area lies adjacent to Tustin
Avenue which is the northwesterly boundary of the City of Newport
Beach; and
WHEREAS, certain property owners in the area described as
Back Bay Annexation No. 1 and located adjacent to Tustin Avenue,
have expressed a desire to annex to the City of Newport Beach; and
WHEREAS, those certain properties included in the City of
Costa Mesa annexation known as Back Bay Annexation No. 1, which front
upon Tustin Avenue, are more logically related to Tustin Avenue which
is a part of an annexation application of the City of Newport Beach
entitled Annexation No. 67, La Canada; and
WHEREAS, those properties fronting on Tustin Avenue which
are included as a portion of both annexation requests have been under
study by the Newport Beach Planning Commission and City Council since
April of 1965; and
WHEREAS, the proposal of the City of Newport Beach
constitutes a logical extension of the city boundaries as one phase
of an overall annexation program in the northwest area of the
present city boundaries of the City of Newport Beach; and
WHEP.EAS,the Local Agency Formation Commission has given
notice of intention to conduct a public hearing on May 14, 1969,
`• on the application for the proposed annexation to the City of Costa
Mesa; and
WHEREAS, the westerly portion of the unincorporated
territory included in the request of the City of Costa Mesa
Back Bay Annexation No. 1 does constitute sound planning practice
and is a logical extension of the city boundaries of the City of
• Costa Mesa;
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Newport Beach urges the County of Orange Local Agency
Formation Commission to continue the hearing on the City of Costa
Mesa Annexation known as Back Bay Annexation No. 1 without
decision to a regularly scheduled meeting of the Local Agency
Formation Commission wherein the application for City of Newport
Beach Annexation No. 67, La Canada, may be heard and considered
concurrently;
BE IT FURTHER RESOLVED that the City Council of the City
of Newport Beach urges the County of Orange Local Agency Formation
Commission to approve that portion of the City of Costa Mesa Back
Bay Annexation No. 1 located westerly of the territory included
within the City of Newport Beach Annexation No. 67, La Canada,
but that portion of the proposed annexation by the City of Costa
Mesa which is also the subject of the City of Newport Beach
Annexation No. 67, La Canada, should be denied.
