A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH APPROVING THE FORM AND CONTENT
OF A PROPOSED AMENDED LEASE BETWEEN THE CITY
AND BALBOA BAY CLUB, INC., TO BE SUBMITTED TO
THE VOTERS OF THE CITY FOR THEIR CONSIDERATION
AT A SPECIAL ELECTION
WHEREAS, Section 420 of the Newport Beach City
Charter requires the approval of a majority of the qualified
electors of the City of any lease or extension thereof for a
longer period than 25 years; and
WHEREAS, the Balboa Bay Club, Inc., a California
corporation, is the lessee of a parcel of City -owned real
property under a lease which will expire on October 31, 1998;
and
WHEREAS, the Balboa Bay Club, Inc., has requested
that the City Council approve an amended lease which would extend
the term of the lease to a total of 55 years and provide for an
increase in rental payable to the City; and
WHEREAS, the City Council, acting upon the advice of
a negotiation committee composed of members of the Council, and
the recommendation of an independent economic consultant, has
reached agreement with the Balboa Bay Club, Inc., on the proposed
terms of an amended lease which the City Council wishes to
submit to the qualified electors of the City;
NOW, THEREFORE, the City Council of the City of
Newport Beach DOES HEREBY APPROVE the form and content of the
proposed amended lease between the City and the Balboa Bay Club,
Inc., a copy of which is attached to this Resolution;
BE IT FURTHER RESOLVED that a copy of said amended
lease be transmitted to all qualified voters within the City
who are eligible to vote at the special election which has been

called for January 13, 1970, for the purpose of determining
whether said amended lease should be approved and executed
on behalf of the City.
ADOPTED this 24th day of November, 1969.
