A RESOLUTION OF THE CITY COUNCIL OF THE CITY
• OF NEWPORT BEACH AUTHORIZING EXECUTION OF AN
ENCROACHMENT AGREEMENT BETWEEN THE CITY OF
NEWPORT BEACH AND PATRICIA C. MARTZ
WHEREAS, there has been presented to the City Council
of the City of Newport Beach an encroachment agreement between
the City of Newport Beach and Patricia C. Martz, record owner of
real property located at 6605 Seashore Drive, Newport Beach,
California, legally described as;
and
The northwesterly one -half of Lot 8 in Block F of
Seashore Colony Tract, in the City of Newport Beach,
County of Orange, State of California, as per map
recorded in Book 7, page 25 of Miscellaneous Maps,
in the Office of the County Recorder of said county;
WHEREAS, said agreement represents a compromise between
the City of Newport Beach and said record owner for purposes of
settlement of an action brought by the City to compel the removal
of certain encroachments extending from the above described real
property into a public street right of way; said action is
entitled People of the State of California vs. Patricia C. Martz,
et al., Orange County Superior Court Case No. 152671; and
WHEREAS, the City Council has considered the terms and
conditions of said encroachment agreement and found them to be
fair and equitable, and in the mutual interests of the parties;
NOW, THEREFORE, BE IT RESOLVED that said encroachment
agreement as the basis for settlement of the above described
Orange County Superior Court Case No. 152671 is approved, and the
Mayor and City Clerk are hereby authorized and directed to
execute the same on behalf of the City of Newport Beach;
BE IT FURTHER RESOLVED that the City Clerk is hereby
directed to cause the said encroachment agreement to be recorded

in the Office of the County Recorder of Orange County.
ADOPTED this 9th day of February, 1970.
