TITLE: APPOINTMENT TO THE ENVIRONMENTAL QUALITY AFFAIRS
COMMITTEE
ABSTRACT:
On April 24, 2013, Carl Cassidy resigned his seat on the Environmental Quality Affairs
Committee ("EQAC") in order to serve on the Water Quality/Coastal Tidelands
Committee. In anticipation of Mr. Cassidy's resignation, the City Council directed the
City Clerk to advertise for the vacancy at its April 23, 2013 City Council meeting.
RECOMMENDATION:
a) Consider the three applications received in the City Clerk's Office by the May 15,
2013 deadline.
b) Make appointments via paper ballot to EQAC pursuant to City Council Policy A-2
(Board, Commission, and Committee Appointments).
FUNDING REQUIREMENTS:
There is no fiscal impact related to this item.
DISCUSSION:
The newly established EQAC was formed by the City Council at the November 27, 2012
City Council meeting. EQAC's purpose is to advise the City Council on policies,
programs and projects that improve or detract from the environmental quality of the City
of Newport Beach ("City"), as requested by the City Council; comment on Notices of
Preparation, as requested by the City Council; and meet as needed to consider issues
referred to them by the City Council.

On February 26, 2013, the City Council appointed Mr. Cassidy to EQAC; however, at
the time of his appointment Mr. Cassidy was already serving on the Water
Quality/Coastal Tidelands Committee. Pursuant to Council Policy A-2, appointees may
serve on only one standing City Board, Commission, or Committee at any time, unless
waived by a majority of the City Council. At the City Council's April 23, 2013 meeting,
the City Council to encourage more public participation decided that
Mr. Cassidy should resign from one of the committees. The City Clerk's Office received
his resignation on April 24, 2013 (Attachment A). Upon receiving the resignation, the
City Clerk, pursuant to City Council Policy A-2 and the Maddy Act, posted the Notice of
Vacancy in the City Clerk's Office, the Library, the City Hall bulletin board, and on the
City's webpage on Wednesday, May 1, 2013; and published the notice in the Daily Pilot
on Saturday, May 4, 2013. The deadline to submit applications was Wednesday,
May 15, 2013. For the one vacancy, three applications were received by the deadline.
EQAC's membership is designed to reflect geographical diversity within the City.
The following persons have submitted EQAC applications for City Council consideration
(Attachment B):

Appointments
Pursuant to City Council Policy A-2, appointments to EQAC will take place in the
following manner:
A. The City Council will vote on all EQAC appointments simultaneously. The voting
will be by paper ballot and the City Clerk will tabulate and announce the results,
including the vote tally.
B. Each member of the City Council will cast a maximum of seven votes for EQAC
on the paper ballot. In order to be appointed, an applicant must receive at least
four votes.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act ("CEQA") pursuant to Sections 15060(c)(2) (the activity will
not result in a direct or reasonably foreseeable indirect physical change in the
environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378)
of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it
has no potential for resulting in physical change to the environment, directly or
indirectly.

Thank you for your phone call advising me that I will need to submit a formal written
resignation (by this email) from the EQAC. I am very grateful to be a member of the Coastal
Tidelands/Water Quality Committee and immensely humbled by the depth of intellect and
range of experience of the committee members.
As I discussed with Council Member Ms. Gardner at the most recent April meeting, I would
respectfully request my continued service on the Coastal Tidelands/Water Quality Committee.
I regret that my being named to two committees has caused additional staff concern.
I, hereby, resign the EQAC. My resignation should be most timely because to my knowledge
the committee has not had any meetings to date.

1) 1 want to be more involved with my community. I think strong community is foundational to all that really counts in life. I see EQAC as
away to show my willingness to work constructively and be involved in a meaningful way. Iran for city council which clearly shows my
interest in Newport Beach.
2) 1 have love of the environment and have studied environmental issues at a graduate level at Claremont. The manner in which we deal
with environmental issues will determine our children's future.
3) 1 worked in the steel recycling industry for nearly 20 years and in addition to trading metals, i managed large scrap recycling industries
in Detroit, Iowa and Southern California. I have been involved numerous times with the EIR process while in the steel industry. In the
1980's and 1990's more stringent environmental rules and regulation made us all somewhat expert on land and water quality issues. A
scrap yard is in a true sense a waste management site.
4) If my position on the Banning Ranch Conservancy Board is seen as a conflict, as I think it would be, I would resign my position there.
Of course my hopes for Banning Ranch would not change but that could well be a plus at EQAC.
