A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH GIVING NOTICE OF PROCEEDINGS
INITIATED BY THE CITY COUNCIL ON ITS OWN
MOTION FOR THE ANNEXATION TO THE CITY OF
NEWPORT BEACH OF CERTAIN UNINHABITED TERRITORY,
KNOWN AS THE COLLINS ANNEXATION - ANNEXATION
NO. 73, AND SETTING A DATE FOR HEARING PROTESTS
TO SAID ANNEXATION
WHEREAS, on the 20th day of July, 1970, the City
Council adopted Resolution No. 7237 initiating proceedings on its
own motion for the annexation to the City of Newport Beach of
certain uninhabited territory pursuant to the provisions of the
Annexation of Uninhabited Territory Act of 1939 and directing
the filing of an application with the Local Agency Formation
Commission of Orange County requesting approval of the initiation
of annexation proceedings of certain uninhabited territory known
as the Collins Annexation - Annexation No. 73; and
WHEREAS, on the 26th day of August, 1970, the Local
Agency Formation Commission of Orange County held a public
hearing on the annexation application of the City of Newport
Beach, and took action approving the application of the City and
authorizing the City Council to proceed with said annexation;
NOW, THEREFORE, the City Council_ of the City of Newport
Beach HEREBY RESOLVES as follows:
1. Proceedings are hereby initiated for the annexation
to the City of Newport Beach of the following described uninhabited
territory by the City Council on its own motion without requiring
a petition by the owners of land within said territory.
2. The territory which is proposed to be annexed to
the City is described as follows:
All that certain real property situate in the County
of Orange, State of California, described as follows:

Those portions of Lots 139 and 144 in Block 50, and
that portion of the Southeasterly one -half of Block 50,
of Irvine's Subdivision as per map thereof recorded in
Miscellaneous Record Map Book 1 at page 88 in the office
of the County Recorder of said Orange County, together
with portions of MacArthur Boulevard, Campus Drive and
Jamboree Boulevard described as follows:
Commencing at the intersection of the centerline of
MacArthur Boulevard (100.00 feet wide) with the centerline
of Campus Drive (80.00 feet wide) as said intersection is
shown on the Map of Tract No. 5902 as per map thereof
recorded in Miscellaneous Map Book 219, pages 28 and 29,
in the office of the County Recorder of said Orange County,
said point being in a curve concave Southwesterly in said
centerline of Campus Drive having a radius of 1200.00 feet
and through which said point a radial of said curve bears
North 2045137" West; thence Westerly along said centerline
of Campus Drive through a central angle of 2029154" an
arc distance of 52.33 feet to a point of cusp in the City
of Newport Beach City Boundary as per Annexation No. 52,
Ordinance No. 1056, said point being in a line parallel
with, and 50.00 feet Northwesterly of, said centerline of
MacArthur Boulevard, a radial of which last said curve
through said point bears North 5015131" West, said point
also being the point of beginning of this description.
Thence Southeasterly along said curve in said centerline
of Campus Drive, leaving said City Boundary, through a
central angle of 45055157" an arc distance of 962.01 feet;
thence South 49019134" East along said centerline, tangent
to said curve, 2789.85 feet to an intersection with the cen-
terline of Jamboree Boulevard as said centerline is
delineated on the map of said Tract No. 5902 as "PROPOSED
C.L. OF RIGHT OF WAY ", thence South 40038326" West along
said centerline, 4116.13 feet to a point in the Easterly
line of the City of Newport Beach City boundary per Ordinance
No. 895, said point also being in the Southerly prolongation
of the Westerly right of way line of the aforementioned
MacArthur Boulevard (110.00 feet wide); thence North 6059144"
West along said Easterly line of Ordinance No. 895,
parallel with and 55.00 feet Westerly of the centerline of
said MacArthur Boulevard and the Northerly prolongation
thereof, 4306.37 feet to the Southwesterly corner of the
hereinabove mentioned Annexation No. 52, Ordinance No. 1056,
said point also being in the Southerly line of Birch Street
(80.00 feet wide);-thence North 83000130" East along said
Southerly line of birch Street, also being the Southerly
line of Annexation No. 52, a distance of 12.62 feet to the
most Southeasterly point of said Annexation No. 52, said
point also being in the Westerly line of said MacArthur
Boulevard (100.00 feet wide) in a curve in said line concave
Easterly and having a radius of 1250.00 feet, a radial of
which said curve through said point bears South 89019138"
West; thence Northerly along said curve in said Westerly
line of MacArthur Boulevard, also being the Easterly line
of said Annexation No. 52, through a central angle of
13048103" an arc distance of 301.09 feet; thence North
13007141" East along said Westerly line of MacArthur
Boulevard and the Northerly prolongation thereof, also being
the said Easterly line of Annexation No. 52, a distance of
669.57 feet to the point of beginning.

3. The reasons of the City Council for desiring said
annexation are: The annexation of said territory to the City
would make municipal services available to the property owners
and lessee, would result in a logical and orderly extension of
the City's boundaries, and would be in the best interests of
the property owners and lessees and the City of Newport Beach
and its residents.
4. Notice is hereby given that the City Council will
hold a hearing for the purpose of considering written protests
against said annexation, made by any person owning real property
within the territory proposed to be annexed, on the 9th day
of November , 1970, at the hour of 7:30 p.m. in the
City Council Chambers located within the City Hall, 3300 Newport
Boulevard, Newport Beach, California, which date of hearing is
not less than 40 nor more than 60 days after the passage of this
resolution.
5. The City Clerk is directed to cause a copy of this
resolution to be published at least twice, but not more often
than once a week, in the Newport Harbor Ensign, a newspaper of
general circulation published in the City, and also in the
Daily Pilot, a newspaper of general circulation published outside
of the City but in the County in which is located the territory
proposed to be annexed, publication to be completed at least
20 days prior to the date set for the hearing. The City Clerk
shall send a copy of this resolution to the governing board of
any school district which, in part or in whole, is included in
the territory sought to be annexed and which has made written
request therefor. The City Clerk is further directed to cause
written notice of such proposed annexation to be mailed to each
person to whom land within the territory proposed to be annexed
is assessed in the last equalized County assessment roll available

on the date proceedings were initiated, at the address shown on
said assessment roll, or as known to said City Clerk, and to any
person who has filed his name and address and the designation
of the lands in which he has any interest, either legal or
equitable, with said Clerk. Said notices shall be given not
less than 20 days before the first public hearing on the proposed
annexation.
