A RESOLUTION OF THE CITY COUNCIL OF THE
• CITY OF NEWPORT BEACH AUTHORIZING EXECUTION
OF A JOINT POWERS AGREEMENT BETWEEN THE CITY
OF NEWPORT BEACH AND THE COUNTY.OF ORANGE IN
CONNECTION WITH THE CREATION AND OPERATION
OF A LAW ENFORCEMENT COMMUNICATIONS SYSTEM
WHEREAS, a grant of.funds from the California Criminal
Justice Council is being.sought- jointly by the Cities in Orange
County and said County, through..the Orang.e County Criminal
Justice Council, for the.creation of a.new.UHF coordi,nated.law
enforcement communications system; and
WHEREAS, in. order to qualify.f.or..s.aid gr.ant.it_ appears
desirable to enter into a joint powers agreement-between the
City of Newport Beach and the County of Orange authorizing said
County to act in behalf of this City .in.the._submission of grant
applications and the administration of such grant;...and
WHEREAS, this City must commit itself to.a_ specific
appropriation to this program for the first year thereof, said
program to be funded 600% grant funds and 40% by this City of
its equipment needs;
NOW, THEREFORE, BE IT RESOLVED that the said joint
powers agreement between the City of Newport_Beach..and the
County of Orange is hereby approved..and.its execution by the
Mayor and City Clerk on behalf of this City is hereby authorized.
BE IT FURTHER RESOLVED that this- City..hereby.mani-
fests its intention to take part in the creation-and-operation
of said communications system; and
BE IT.FURTHER RESOLVED that this City hereby obligates
• itself to acquire that equipment needed for said system, con-
tained in the attached.Schedule "A" listing items to be acquired
during the first year together with the cost basis thereof; and
BE IT FURTHER RESOLVED that this City indicates its

desire, but does not obligate itself in any .way, to acquire
that equipment listed in Schedules "B" and "C" in the years
subsequent to the first year of_said program,.and
BE IT FURTHER RESOLVED that the-total amount obli-
gated for this City for .the ,.first year of..said.program is the
sum of $28,000.00 and this..City realizes.that -there may be
some savings from this ,amount realized because of- quantity
buying and installation -of- said... equipment.

JOINT POWERS AGREEMENT
This Agreement by and between the County of Orange, hereinafter
referred to as "County" and the City of Newport Beach
hereinafter referred to as "City" on this day of
1971, is entered into for the following reasons:
A. The Orange County area, including both incorporated and unin-
corporated territory, is in need of a new ultrahigh frequency coordina-
ted law enforcement communications system to facilitate the detection.and
prevention of crime.'
B. Funds.may be available from the:California Criminal Justice
Council, Sacramento; California, in° the'. form of a. grant. to permit' the cre
anon of such system thr-ough'the bodies 'which 'administer such grants.
C. Applications for grants for law enforcement purposes must be
made through the Orange County Criminal Justice Council and must be made
jointly on behalf of the County of Orange and the cities therein, and a
grant contract is effective for 12 months only.
D. The California Government Code, Section 6500 et seq. autho-
rizes the joint exercise by agreement between two or more local public
agencies of any power common ,to them, and the County of Orange and the
cities thereat all possess the power to study, develop, and use radio
communications for law enforcement purposes.
E. County has performed considerable research into the kind and
nature of the communications problems involved and the solution thereof,
.which City desires, to have made available to it.
Now, therefore, in consideration of the benefits to be received
by each party as a result of their joint action, the parties hereto,
agree as follows:
1. They authorize the application to the California Criminal
Justice Council through the Orange County Criminal Justice Council
on their behalf of an Action Grant Proposal for the development and
establishment of the radio system referred to hereinabove. Said
application and the contract arising therefrom may be executed on

1 behalf of all parties hereto by the Chairman of County's Board of
2 Supervisors;
3 2. For purposes of the grant application, contract, and for
• 4 administration of the program in the event it is approved, the B Controller of the County of Orange is authorized to act as fiscal
e officer, and the Orange County Director of Communications shall 'act
7 as project director.
8 3. Prior to the submission of the Action Grant Proposal,.County
9 will provide City with its estimates of the equipment needs of City
10 for City's beneficial participation in the system, together with the
11 estimated cost thereof, and City . shall by resolution designate the
12 equipment and services it desires to acquire, and obligate itself
13 to pay that proportion of the 'cost thereof as- determined by.the grant.,
14 In the event that City wishes to acquire the equipment over'a period
15 of time longer than one grant . year, it may, prior to the application
16 fora subsequent grant or grants, provide by resolution the equipment.
17 and services desired in that grant year and obligate itself for its.

18 'proportionate share of the cost thereof.,

19 4. County or City may terminate this Agreement at any time upon
20 thirty (30) days' written notice given to the other party, but such
.21 party shall.remain liable for its proportionate share of the cost
22 of equipment or services rendered through the termination date plus
23 any damages sustained by County by reason of such termination.
24 5. Upon request of City, County will undertake the negotiation
25 or4 behalf. of City of the purchase of equipment and services for such
26 system but, in the absence of further agreement between the parties
•27 hereto, City shall order and pay for its own such purchases.
28 6. County may, but shall not be required to enter, into other.
29 joint powers agreements concerning this subject matter with other
•30 cities, and nothing contained herein shall.preclude City from entering
IP1 into other agreements with County or other cities for the purchase,
32 installation, or servicing of said communications equipment.

7. County agrees to permit City to make use of any and all
research, technical reports, plans, or other documents developed by
County for implementation of said communications system.
