• A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AUTHORIZING THE EXECUTION OF
AN AGREEMENT BETWEEN THE CITY OF NEWPORT BEACH,
THE IRVINE COMPANY AND E. 0, RODEFFER IN
CONNECTION WITH A SPACE EASEMENT
WHEREAS, The Irvine Company is the owner of that
certain real property located in the City of Newport Beach,
located on the northwest corner of San Nicolas Drive and future
Avocado Avenue, (subject property); and
WHEREAS, E. 0. Rodeffer is the Lessee of the subject
property under a long term ground lease agreement with Lessor
dated November 13, 1969; and
WHEREAS, Lessee proposes to construct a multiple
story office building on the subject property with increased
floor area as permitted by Section 506, subsection 3, of the
Uniform Building Code by providing an increase in the separation
of the building on three sides; and
WHEREAS, The Irvine Company and E. O. Rodeffer have
agreed to keep said separation of the building on three sides
clear and unobstructed during the term of their ground lease;
NOW, THEREFORE, BE IT RESOLVED that said agreement
for the space easement above described is approved and the
Mayor and City Clerk are hereby authorized and directed to
execute the same on behalf of the City of Newport Beach.
ADOPTED this 24th day of May 1971.
