TITLE: Addition of Off - Street Parking Meter Zones
ABSTRACT:
California Vehicle Code ( "CVC ") Sections 32 and 22508 and Newport Beach Municipal
Code ( "NBMC") Section 12.44.030 allow the City to establish off- street parking meter
zones by resolution. City Council approved the acquisition and installation of 23 Digital
Luke Machines (multi -space pay stations) for use at the Balboa Parking Lot ( "Balboa
Lot ") and the Corona del Mar State Beach Parking Lot ( "CdM Lot'). Staff recommends
establishing the Balboa Lot and CdM Lot as off - street parking meter zones.
RECOMMENDATION:
Adopt Resolution No. 2013- 33 to establish Balboa Lot and the CdM Lot as off - street
parking meter zones and establish rates for the new zones consistent with the fess
presently charged by the City to park in the lots.
FUNDING REQUIREMENTS:
There is no fiscal impact related to this item.
On February 26, 2013, City Council approved the acquisition and installation of 23
Digital Luke Machines (multi -space pay stations) for use at the Balboa Lot and the CdM
Lot. The pay stations offer drivers the convenience of paying for parking by cash, credit
card, pay -by -phone or web application and will utilize a "Pay by License Plate" model,
enforced by vehicles using License Plate Recognition technology.

Although sufficient personnel will be present at the parking lots to help visitors with the
pay stations, respond to complaints and answer questions, drivers will be paying for
parking at the machine or through their mobile device. CVC Sections 32 and 22508 and
NBMC Section 12.44.030 allow for the establishment of off - street parking zones.
Currently, there are 28 parking meter zones within the City. Balboa Lot and CdM Lot
would be the 29th and 30° parking meter zones.
The parking rates and operating hours for both parking lots will remain unchanged.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find that the adoption of this resolution is not subject
to the California Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2)
(the activity will not result in a direct or reasonably foreseeable indirect physical change
in the environment) and 15060(c)(3) (the activity is not a project as defined in Section
15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3,
because it has no potential for resulting in physical change to the environment, directly
or indirectly.
