The process to fill the vacancies shall be followed in accordance with City Council Policy A -2 — Board, Commission and Committee Appointments. At the conclusion of the application period (May 15, 2013) the committee reviewed the applications on file and conducted interviews with selected applicants on Tuesday, June 4, 2013. 2 of 128 BOARD AND COMMISSION SCHEDULED VACANCIES — CONFIRMATION OF NOMINEES June 11, 2013 Page 3 Since only seven applications were received for the four vacancies on the Building and Fire Board of Appeals, staff is recommending that the City Council waive the portion of Council Policy A -2 that requires two or more applications for each vacant seat. Further, one of the seats to be vacated on the Building and Fire Board of Appeals is currently being held by Richard Luehrs who would like to retain his seat on the Board. If the City Council desires to nominate Richard Luehrs to the Board, the portion of Council Policy A -2 which does not allow a person to serve for more than two consecutive four -year terms will need to be waived. All other provisions of City Council Policy A -2 have been complied with. The appointments to fill the vacancies are scheduled for Tuesday, June 25, 2013. All new terms will be effective July 1, 2013, with an expiration date of June 30, 2017, excluding the two current vacant seats on the Building and Fire Board of Appeals, whose terms will expire on June 30, 2016. It should be noted that Stephanie Murguia (Board of Library Trustees) and Christopher Trela (City Arts Commission) are eligible for reappointment; however, they have opted to not reapply for the upcoming scheduled vacancy on their respective Board or Commission. ENVIRONMENTAL REVIEW: Staff recommends the City Council find this action is not subject to the California Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. In that time, the Newport Beach Public Library, its resources, and the knowledgeable staff have supported me through all of my educational journeys. As a high school student at Corona del Mar High School, I would go to the Central Library after school to do homework, meet with study groups, and do research for my Senior Project on cryptography. After some time spent away from Newport Beach to attend UCLA, I returned to live at home for law school, where I spent countless nights and weekends studying for final exams and, ultimately, the California Bar Exam last summer at the Central Library. After a day -in and day -out routine over nearly three months, I came to realize what an important contribution to my life the Newport Beach libraries have made. Now that I am settled, I would like to support the Newport Beach libraries that have supported me. Having lived and benefitted from the community since I was 8 years old I now see this as an opportunity to give back to my community. My educational training and professional experiences are broad. I have performed multiple projects in almost all categories of construction. Over the last 30 years I have been the licensed architect for custom & tract single & multi - family residential units, restaurants, fast food drive - through facilities, office commercial, retail, hospitality, educational, medical & industrial types of projects. Recently completed projects include Concorde College Dental School, car dealerships (Land Rover, Subaru & Toyota) and a hazardous material distribution facility (Frazee Paint). I have also provided designs, plans and permits for high pile storage facilities in excess of one million square feet (Whirlpool & Dart facilities) as well as designs for freezer facilities for Nestle Corporation & Bird's Eye. I have developed strong communication ties with both planning and building directors in many Southern California Cities due to my knowledge and understanding of the municipal and building codes. As a result of my 30 years in architecture I have become an expert for processing of Conditional Use Permits and presenting to Community & Architectural Review Boards. My knowledge and experiences have fostered resolution through mitigating discourse with a keen focus for the health, safety, and welfare of the public. I believe my approach has improved both the agency and the client's end results. "I've always been involved in creative endeavors, but it was the lack of art that appealed to me while decorating my new home that inspired me to begin painting," he says. The native Austrian now has several of his own pieces that he rotates through his home, which is also his working studio. "I need this reflection because it uplifts me and keeps me confident in my ability," he adds. Magrutsche specializes in "liminal abstract art, what he calls the space between abstract and concrete. He credits his uncle the famous Austrian painter Adolf Frohner, with teaching him the power of abstract. He says, "I want the color and design in my art to grab you, engage you and seduce you into getting lost in its content." The public spaces of a business are an extension of that company's image. Each time a prospective customer enters your lobby, reception area or corporate conference room, an almost immediate impression of your business is created. Because such first impressions can be so critical to your company's image, the appropriate message must be conveyed. The proper utilization of art can serve as an important tool in enhancing your image and personalizing your public spaces. The art displayed in your business should make a statement that your company is modern, open- minded, and creative. The abstract painter eschews representational art because even the best painting of a horse can never compete with a real horse. He likes abstract art because it involves the viewer and is proactive. "It's a lost cause to paint nature," Magrutsche said_ "Michaell's Upbeat Abstracts," a group of acrylic paintings on display at Newport Beach Central Library shows a developed sense of art by a second- generation abstract painter. Magrutsche, who was born in Vienna, Austria, grew up exposed to the art of his uncle, Adolf Frohner, a famous Austrian abstract painter. Despite the strong influence, Magrutsche said he found his own way. He believes art should inspire and uplift. "These days when I enter a room, I want to feel a painting -- I want its color and design to grab me," Magrutsche said. "I am not an elitist artist -- either you like it or you don't." 65 of 128 He likes to paint what he calls "liminal" abstracts, which means the viewer interprets the space between the lines and brings something of themselves to the painting. How we have lost sight of art's purpose. by Michaell Magrutsche ©2007 Have you ever passed up an opportunity to purchase a piece of art you love only because you couldn't decide where you would display it? Maybe you felt it would clash with your decor, or that it was not in proportion to your space. Conversely, have you ever acquired a painting that you were indifferent towards simply because you envisioned it fitting into the decor? Sadly, the acquisition of art has degenerated into this either /or decision based upon a piece's eventual display site. Visual art must be capable of standing on its own. A piece of art should be an extension or expression of one's self and, therefore, fit anywhere. Artwork should have a profound meaning to you personally, or should touch your soul. If you purchase art that does not meet these criteria, then it is simply relegated to the status of one of the components of your interior design scheme, like a lampshade or the drapes. If you truly love a certain piece, you should never have to consider how it would fit into your decor. Buying art to blend with the decor will not only eventually bore you, but does a disservice to the artist who wants his pieces prominently displayed. Artists and art collectors, worldwide, rarely ask themselves where to display a canvas. They will hang a painting wherever it maximizes their viewing pleasure. Collectors' tastes in art change, just like their preferences in automobiles. They go through different phases with each: artists, styles, or schools of art; and SUVs, sports cars, or luxury sedans. 67 of 128 Over the past few decades, the relationship between buyer and art has diminished. People are acquiring art to either satisfy their egos or as an investment. They focus on the "hot" artist of the day in order to flaunt their status, or they view their acquisition as a commodity with an eye towards appreciation. This results in many purchasers failing to appreciate the wonderful properties and intrinsic values that art possesses. So, the next time you consider a work of art, do not ask yourself where it will fit. If a painting has an effect on you, display it with abandon. Remind yourself that you are the custodian of a sliver of someone's soul expression to be handed down for someone else's enjoyment. A native of Austria, Magruische has been employed in, virtually every aspect of the entertainment industry, from voiceover work and television broadcaster to television producer, pmgmmmer and distributor. His varied career began with a "fascination for the television medium." After coming to Southern California in 1982, he co-founded a UHF TV licensing company. When cable "hit big" in the states, Magmtsche embarked on a related endeavor to form a partnership with Austria GM Media to develop television programming and media events focused on the European markets. "Because of the contacts I had made here, 1 was able to help put together a children's pro- gram, which was essentially a pilot project for one of the first interactive CD- Roms," he says. I have to say that I have always enjoyed working with Americans in this industry." "I had to take a chance and try this," he says. "So I came back to Southern California and lived for a time in Evans' home. "For example, if someone asks what a particular film is about and the response is that its a Western, that doesn't offer any insight into what the movie is really about. My parents have lived on Balboa Island since 1977, and since enrolling at USC that year, I have either lived in the area or visited frequently to see family and friends. Following graduation from the University of Southern California with a Bachelor of Science degree in Civil Engineering I lived and worked in Los Angeles and San Diego Counties. In 20051 moved to Newport Beach. As a professional Civil Engineer I have worked with dozens of municipalities, counties, states, and agencies having jurisdiction in the drafting, submission, and review of projects for their communities. In my nine years of experience I have gained an appreciation for the work and oversight of agency planning departments in reviewing plans submitted for approval.
