TITLE: Mobilitie Telecommunications Permit for Obelisk Located at 20661
Newport Coast Drive (PA2013 -003)
ABSTRACT
Mobilitie requests a Telecommunications ( "Telecom ") Permit to install a 55 -foot high
stealth Telecom facility (obelisk). The proposal includes the installation of six panel
antennas and equipment for Verizon Wireless. The design can accommodate one
additional carrier within the obelisk and equipment area for a total of two carriers.
Should the facility be approved, the second carrier would be required to obtain a
separate Telecom approval pursuant to Municipal Code Chapter 15.70 (Wireless
Telecommunication Facilities). City Council review is required because the applicant
proposes the facility approximately five feet above the 50 -foot height limit.
RECOMMENDATION
Conduct Telecom application review; and
2. Adopt the Draft Resolution finding the project categorically exempt from the
California Environmental Quality Act pursuant to Section 15303 (Class 3 — New
Construction or Conversion of Small Structures) of the CEQA Guidelines and
approving Telecom Permit No. TP2013 -001 (Attachment No. CC 1).

Project Setting
The proposed Telecom facility is located on County of Orange owned - property within
the closed Coyote Canyon Landfill. The 1,450- square -foot lease area is adjacent to
Newport Coast Drive near the State Highway 73 and across from Sage Hill School. The
proposed project is not located within an Environmental Study Area. The topography of
the site varies greatly, and the grade at the lease area is approximately 485 feet in
elevation.
Project Description
Mobilitie develops and owns towers for Telecom service providers, such as Verizon
Wireless. The application is a request to install a 55 -foot high stealth structure to be
designed as an obelisk (four- sided, narrow tapering monument which ends in a
pyramid -like shape at the top) that includes the installation of six Verizon Wireless panel
antennas mounted within the structure. The lease area includes the proposed obelisk
and the equipment area, which would be screened with an eight -foot high decorative
block wall and native shrubs. The facility can accommodate one additional future

carrier. The applicant's project description and justification is provided as Attachment
No. CC 3. The site is intended to improve coverage, which the applicant states is weak
in this area (Coverage Maps provided as Attachment No. CC 4).
Photographic visual simulations from two vantage points depicting the existing and
proposed conditions are included as Attachment No. CC 5. The plans depicting the
proposed project are provided as Attachment No. CC 6.
Analysis
Consistency with General Plan and Zoning Code
The General Plan designates the subject property as Parks and Recreation (PR), which
is intended to provide for active public or private recreational use, such as parks and
golf courses. The corresponding PR Zoning District is intended to provide for areas
appropriate for land used or proposed for active public or private recreational uses. The
proposed future land use for the closed landfill site is a golf course, which is considered
to be consistent with these designations. The proposed project is an accessory use and
structure and is also consistent with these designations. The Zoning Code refers to the
Telecom Ordinance (Chapter 15.70) for the regulation of wireless facilities. No public
view points or coastal view roads are located in the vicinity of the proposed structure.
Conformance with Chapter 15.70 (Wireless Telecommunication Facilities)
Chapter 15.70 is available online at the following link:
Chapter 15.70 of the Municipal Code includes technology, height, location, and design
requirements for Telecom facilities. The stated purpose of Chapter 15.70 is:
.. to provide for wireless telecommunication ( "telecom ") facilities on public and
private property consistent with federal law while ensuring public safety, reducing
the visual effects of telecom equipment on public streetscapes, protecting scenic,
ocean and coastal views, and otherwise mitigating the impacts of such facilities.
More specifically, the regulations contained herein are intended to:
1. Encourage the location of antennas in non - residential areas.
2. Strongly encourage co- location at new and existing antenna sites.
3. Encourage telecom facilities to be located in areas where adverse impacts
on the community and on public views are minimized."

Technology
The proposed facility will utilize the most efficient and diminutive available technology in
order to minimize the number of facilities and reduce their visual impacts, as required by
Section 15.70.040 (Available Technology).
Height
The proposed obelisk will measure 55 feet in height from the finished surface of the
lease area. Section 15.70.050 (Height and Location) specifies that the City Council may
approve antennas up to 15 feet above the maximum height limit. The subject property
is located within the City's 32/37 height limit area as specified in Section 20.30.060.C.2
(Height Limit Areas). The maximum height limit for antennas/Telecom facilities is 50
feet in this height limit area. Because the proposed obelisk exceeds this height limit,
City Council approval is required. Mobilitie has requested the additional height to meet
Verizon Wireless's service coverage objectives, and to allow future collocation of a
second carrier.
Location
Section 15.70.050.B (Location) provides eight location categories in priority order that
are listed below. The priority order ranks the types of wireless facilities from most
desirable to least desirable. The proposed project is for a new "stealth" structure, which
is prioritized fourth (d) out of the eight categories:
,,a. Wall, roof or existing co- location structure or site;
b. Existing pole, light standard, or utility tower;
c. Commercial sign or architectural feature;
d. New or existing "stealth" structure other than a false tree;
e. New false tree;
f. New "Slim Jim" monopole (i.e. with no antenna elements other than the pole
itself);
g. New standard monopole with attached antenna elements;
h. New lattice tower."
"Stealth" is defined within Section 15.70.030 as a "Telecom facility in which the antenna,
and sometimes the support equipment, are hidden from view in a false tree, monument,
cupola, or other concealing structure which either mimics, or which serves as, a natural
or architectural feature." The applicant has indicated that no sites within location
categories a -c are feasible. The property surrounding the lease area is not developed
with any existing buildings, structures, or utility poles /towers that could accommodate a
Telecom facility, and alternative candidate sites are not feasible.

Collocation Requirements
To limit the adverse visual effects of a proliferation of Telecom sites in the City, Section
15.70.050.0 (Co- Location Requirements) requires a new Telecom facility proposed
within 1,000 feet of an existing facility to collocate on the same site as the existing
facility unless the review authority determines that collocation is not feasible. The
proposed facility is not within 1,000 feet of an existing Telecom facility. Outside of the
1,000 -foot radius, Telecom facilities are located along Newport Coast Drive on
streetlight standards and at the closed landfill's Gas Recovery System facility. To meet
the intent of the collocation requirement, the obelisk has been designed to
accommodate a second future carrier; however, that carrier has not yet been identified.
Design Standards
Section 15.70.060 (Design Standards) requires proposed freestanding antennas to be
visually compatible with surrounding buildings and vegetation. In reviewing this
application, Section 15.70.060 states that the City Council shall consider the blending,
screening, and size of the proposed facility.
1. Blending. The extent to which the proposed facility blends into the surrounding
environment or is architecturally integrated into structure.
2. Screening. The extent to which the proposed facility is concealed, screened or
camouflaged by existing or proposed new topography, vegetation, buildings or
other structures.
3. Size. The total size of the proposed facility, particularly in relation to
surrounding and supporting structures."
The area surrounding the lease area is not developed and no trees are in the vicinity;
therefore, the obelisk is not screened from view. However, the design of the obelisk
allows the antennas to be fully concealed and screened. The applicant's intent was to
design an architectural feature that would be visually compatible with its surroundings
and not detract from the natural landscape. The support equipment will be enclosed by
an eight -foot high block wall that will be partially screened by landscaping. Staff
believes the total size of the facility is compatible with the size and topography of the
closed landfill site.
Findings
Section 15.70.070.F.3 provides that proposed Telecom facilities may be approved if City
Council makes the following findings:
,,a. The approval is necessary to allow the facility to function as intended and
identified alternatives to the proposal are not feasible.

b. The approved facility will not result in conditions which are materially
detrimental to nearby property owners, residents, and businesses, or to public
health and safety."
The applicant states that the proposed project is necessary for Verizon Wireless to meet
its coverage objectives. The existing coverage for Verizon Wireless is weak with a high
probability of dropped calls. Furthermore, the additional height allows for future
collocation with the required minimum vertical separation between antennas.
Due to the constraints in this geographic area, staff supports this area of the former
landfill site as an appropriate location for the proposed Telecom facility. Few alternate
sites are available in the vicinity because the Municipal Code does not allow Telecom
facilities in open space zoning districts, which is the zoning of the parcel on the east
side of Newport Coast Drive. The applicant did analyze alternate sites and determined
that those sites are not feasible because of property owner interest, topography,
Municipal Code requirements, coverage objectives, and Mobilitie's mission statement to
develop and maintain multi- carrier facilities. The three sites analyzed were Sage Hill
School, an access road to the Gas Recovery System facility, and in the nearby
CalTrans right -of -way on streetlight standards (See Attachment No. CC 3 for an exhibit
of the alternative sites).
Other than Sage Hill School across Newport Coast Drive, the proposed facility is not
located near any residences or businesses. The increased coverage will enhance
access to emergency service calls. The proposed facility will comply with the rules,
regulations and standards of the Federal Communications Commission (FCC), thus
ensuring public health and safety. Moreover, the proposed facility will not generate any
adverse traffic, noise, or odor impacts.
Alternatives
The City Council may also approve a modified project or deny the application. Should
the City Council determine that the required findings cannot be made and the proposed
project does not meet the purpose and intent of Chapter 15.70, a draft resolution for
denial of the project is provided as Attachment No. CC 2. It may be necessary for the
City Council to include additional facts regarding the required findings.
ENVIRONMENTAL REVIEW
Staff recommends the City Council find this project exempt from the California
Environmental Quality Act ( "CEQA ") pursuant to Section 15303 (Class 3 — New
Construction or Conversion of Small Structures) of the CEQA Guidelines, California
Code of Regulations, Title 14, Chapter 3, because it has no potential to have a
significant effect on the environment. Class 3 exempts the construction of limited
numbers of new, small facilities or structures and installation of small new equipment
and facilities in small structures.

NOTICING
Notice of this hearing was mailed to all property owners within 300 feet of the property,
published in the Daily Pilot, and posted at the project site a minimum of 10 days in
advance of this meeting consistent with the Municipal Code. Additionally, the item
appeared on the agenda for this meeting, which was posted at City Hall and on the City
website.

RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH APPROVING TELECOMMUNICATIONS
PERMIT NO. TP2013 -001 FOR A TELECOMMUNICATIONS
FACILITY LOCATED AT 20661 NEWPORT COAST DRIVE
(PA2013 -003)
THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH HEREBY FINDS AS FOLLOWS:
SECTION 1. STATEMENT OF FACTS.
An application was filed by Mobilitie, with respect to property located at 20661 Newport
Coast Drive, legally described as Block 128 of the Irvine Subdivision, requesting
approval of a Telecommunications ('Telecom ") Permit pursuant to Chapter 15.70 of the
Newport Beach Municipal Code.
2. The applicant requests a Telecom Permit to install a 55 -foot high stealth Telecom
facility (obelisk). The proposal includes the installation of panel antennas and
equipment for Verizon Wireless. The design can accommodate one additional carrier
within the obelisk and equipment area for a total of two carriers. Should the facility be
approved, the second carrier would be required to obtain a separate Telecom approval
pursuant to Municipal Code Chapter 15.70 (Wireless Telecommunication Facilities).
3. The subject property is located within the Parks and Recreation (PR) Zoning District and
the General Plan land use designation is Parks and Recreation (PR).
4. The subject property is not located within the coastal zone.
5. Pursuant to Municipal Code Section 15.70.050.A.2 Special Review by City Council was
held on June 11, 2013, in the City Hall Council Chambers, 100 Civic Center Drive,
Newport Beach, California. A notice of time, place and purpose of the meeting was
given in accordance with the Newport Beach Municipal Code. Evidence, both written
and oral, was presented to, and considered by, the City Council at this meeting.
SECTION 2. CALIFORNIA ENVIRONMENTAL QUALITY ACT DETERMINATION.
This project has been determined to be categorically exempt under the requirements of the
California Environmental Quality Act under Class 3 (New Construction or Conversion of Small
Structures). Class 3 allows the installation of small new equipment and facilities in small
structures. The proposed project involves the installation of an architectural feature
constructed to hold up to twelve (12) panel antennas, and the installation of screened
appurtenant equipment for a Telecom facility.
SECTION 3. REQUIRED FINDINGS.
In accordance with Chapter 15.70 of the Newport Beach Municipal Code, the following
findings and facts in support of such findings are set forth:

A. The approval is necessary to allow the facility to function as intended and identified
alternatives to the proposal are not feasible.
Facts in Support of Finding:
1. The Telecom facility was designed as a stealth facility at 55 feet in height to meet the
coverage objectives of Verizon Wireless and to facilitate future collocation opportunities
for one additional carrier.
2. The application includes documentation indicating a need to provide and improve Verizon
Wireless coverage within the area, and the Telecom facility is intended to eliminate gaps
in existing Verizon Wireless coverage.
3. The area is difficult to service because of the limited opportunities in the area to construct
Telecom facilities. The applicant identified three alternate locations and evaluated the
potential of each location to meet code requirements and coverage objectives. The
alternate locations are not feasible because of property owner interest, topography,
Municipal Code requirements, coverage objectives, and Mobilitie's mission statement to
develop and maintain multi- carrier facilities.®
Findin :
B. The approved facility will not result in conditions which are materially detrimental to
nearby property owners, residents, and businesses, nor to public health or safety.
Facts in Support of Finding:
1. The proposed facility will comply with the applicable rules, regulations and standards of
the Federal Communications Commission (FCC), thus ensuring public health and safety.
2. The proposed facility will only require periodic maintenance and will not generate any
adverse impacts, such as traffic, noise, or odor.
3. The proposed project does not impact coastal views as no public view points or coastal
view roads are located in the area.
4. The facility will improve service for routine and emergency communication.
Finding:
C. The proposed project is in conformance with the technology, height, location, and design
standards of Chapter 15.70 of the Municipal Code.

1. The proposed Telecom facility (antennas, Global Positioning System, and support
equipment) utilizes the most efficient and diminutive available technology in order to
minimize the number of facilities and reduce any visual impacts.
2. The proposed Telecom facility is 55 feet in height. A Telecom facility between 50 feet and
65 feet in height is allowed at the subject property with City Council approval.
3. The proposed Telecom facility is a new stealth structure, which is prioritized fourth of eight
location categories.
4. The proposed facility is not within 1,000 feet of an existing Telecom facility. The applicant
proposes the obelisk for Verizon Wireless with the ability to accommodate a second
carrier in the future.
5. The design of the obelisk allows the antennas and equipment to be fully concealed and
screened. The facility was designed as an architectural feature that would be visually
compatible with its surroundings and not detract from the natural landscape. The support
equipment will be enclosed by an eight -foot high block wall that will be partially screened
by landscaping. The total size of the facility is compatible with the size and topography of
the subject property.
SECTION 4. DECISION. N�
NOW, THEREFORE, BE IT RESOLVED:
1. The City Council of the City of Newport Beach hereby approves Telecom Permit No.
TP2013 -001, subject to the conditions set forth in "Exhibit A," which is attached hereto
and incorporated by reference. iO
2. This resolution was approved and adopted at a regular meeting of the City Council of the
City of Newport Beach, held on the 11t day of June, 2013, by the following vote, to wit:

EXHIBIT "A"
CONDITIONS OF APPROVAL
1. The development shall be in substantial conformance with the approved plot plan,
antenna and equipment plans, elevations, and photographic simulations, except as noted
in the following conditions.
2. Anything not specifically approved by this Telecom Permit is not permitted and must
be addressed in a separate and subsequent Telecom Permit review.
3. The Telecom facility approved by this permit shall comply with all applicable rules,
regulations, and standards of the Federal Communications Commission (FCC).
4. The applicant is required to obtain all applicable permits from the City Building Division
and Fire Department, including a permit for the generator. Prior to the issuance of any
building, mechanical, and /or electrical permits, architectural drawings and structural
design plans shall be submitted to the City of Newport Beach for review and approval
by the applicable departments. A copy of these conditions of approval shall be
incorporated into the drawings approved for the issuance of permits.
5. The Telecom facility approved by this Telecom Permit shall comply with any
easements, covenants, conditions or restrictions on the underlying real property upon
which the facility is located.
6. The applicant shall continually maintain the wireless Telecom facility so that it retains
its original appearance at the time the building permit is finaled by the City of Newport
Beach.
7. Any future facilities proposed by other carriers to be located within 1,000 feet from the
subject property shall be approved to co- locate at the same site by the property owner
or authorized agent, unless otherwise approved by the Community Development
Director.
8. Within 30 days after installation of the Telecom facility, a radio frequency (RF)
compliance and radiation report prepared by a qualified RF engineer acceptable to the
City shall be submitted in order to demonstrate that the facility is operating at the
approved frequency and complies with FCC standards for radiation. If the report
shows that the facility does not so comply, the use of the facility shall be suspended
until the facility is modified to comply and a new report has been submitted confirming
such compliance.
9. Prior to issuance of building permits, a deposit of $5,000 shall be paid to the City of
Newport Beach. This deposit is required by the Planning Division to ensure
preparation and submittal of the RF Compliance and Radiation Report, referenced in
Condition No. 8. The deposit will be used to defray any and all fees associated with
review of the report by City staff or an independent technical consultant, pursuant to

Section 15.70.070 B -10 of the Telecom Ordinance. Any unused deposit fees will be
refunded to the applicant upon determination of compliance with the approved
frequency and FCC standards.
10. The applicant shall not prevent the City of Newport Beach from having adequate
spectrum capacity on the City's 800 MHz radio frequencies at any time.
11. The applicant shall provide a "single point of contact" in its Engineering and
Maintenance Departments that is monitored 24 hours per day to insure continuity on
all interference issues, and to which interference problems may be reported. The
name, telephone number, fax number and e-mail address of that person shall be
provided to the Planning Division and Newport Beach Police Department's Support
Services Commander prior to activation of the facility.
12. Should interference with the City's Public Safety radio equipment occur, use of the
Telecom facility authorized by this permit shall be suspended until the radio frequency
interference is corrected and verification of the compliance is reported.
13. The facility shall utilize a frequency range of 746 -757 MHz, 776 -787 MHz, 880 -890
MHz, 891.5 -894 MHz, 835 -845 MHz, 846.5 -849 MHz, 1885 -1890 MHz, 1900 -1905
MHz, 1965 -1970 MHz, 1980 -1985 MHz, 2120 -2130 MHz, and 1720 -1730 MHz
spectrum. Any change or alteration to the frequency range shall require the prior
review and approval of the Community Development Director.
14. The applicant recognizes that the frequencies used by the cellular facility located at
20661 Newport Coast Drive are extremely close to the frequencies used by the City of
Newport Beach for public safety. This proximity will require extraordinary "comprehensive
advanced planning and frequency coordination" engineering measures to prevent
interference, especially in the choice of frequencies and radio ancillary hardware. This is
encouraged in the "Best Practices Guide" published by the Association of Public- Safety
Communications Officials - Intemational, Inc. (APCO), and as endorsed by the Federal
Communications Commission (FCC).
15. Appropriate information warning signs or plates shall be posted at the access locations
and each transmitting antenna. In addition, contact information (e.g., a telephone
number) shall be provided on the warning signs or plates to arrange for access to the
facility. The location of the information warning signs or plates shall be depicted on the
plans submitted for construction permits.
16. No advertising signage or identifying logos shall be displayed on the Telecom facility
except for small identification, address, warning and similar information plates. A detail
of the information plates depicting the language on the plate shall be included in the
plans submitted for issuance of building permits.
17. The Telecom facility shall not be lighted except as deemed necessary by the Newport
Beach Police Department for security lighting. The night lighting shall be at the lowest

intensity necessary for that purpose and such lighting shall be shielded so that direct
rays do not shine on nearby properties.
18. The lease area is located in a Very High Fire Hazard Severity Zone. All construction
shall meet the requirements of this zone.
19. The lease area is located on a closed landfill site with methane gas. Proper
mitigations shall be provided for the construction and erection of the Telecom facility.
20. Access shall be required through the existing chain link fence or any future wall /fence
enclosing the area for emergency personal in the event of an emergency.
21. If any of the existing public improvements surrounding the site are damaged by the
private work, new concrete sidewalk, curb and gutter, street pavement, and any other
public improvements shall be required by the City at the time of private construction
completion. Said determination and the extent of the repair work shall be made at the
discretion of the Public Works Inspector.
22. All project related equipment shall be stored on site during construction.
23. An Encroachment Permit is required for all work activities within the public right -of-
way. Any lane closures will require approval of Traffic Control plans.
24. All work in the public right -of -way shall be in conformance with the requirements of
Municipal Code Chapter 13.20 (Public Rights -of -Way).
25. Should the property be sold or otherwise come under different ownership, any future
owners or assignees shall be notified of the conditions of this approval by the
applicant, current property owner, or leasing agent.
26. The applicant shall ensure that lessee or other user(s) shall comply with the terms and
conditions of this permit, and shall be responsible for the failure of any lessee or other
user(s) under the control of the applicant to comply.
27. Any carrier who intends to abandon or discontinue use of the Telecom facility must
notify the Planning Division by certified mail no less than 30 days prior to such action.
The operator or property owner shall have 90 days from the date of abandonment or
discontinuance to reactivate use of the facility, transfer the rights to use the facility to
another operator, or remove the abandoned antennas and equipment and restore the
site.
28. The City reserves the right and jurisdiction to review and modify any Telecom Permit
approved pursuant to Chapter 15.70 of the Newport Beach Municipal Code, including
the conditions of approval, based on changed circumstances. The operator shall notify
the Planning Division of any proposal to change the height or size of the facility;
increase the size, shape or number of antennas; change the facility's color or materials
or location on the site; or increase the signal output above the maximum permissible

exposure (MPE) limits imposed by the radio frequency emissions guidelines of the
FCC. Any changed circumstance may require approval of an amendment to the
original Telecom permit.
29. This Telecom Permit may be modified or revoked by the City Council should they
determine that the facility or operator has violated any law regulating the Telecom
facility or has failed to comply with the requirements of Chapter 15.70 of the Municipal
Code, or this Telecom Permit.
30. This approval shall expire unless exercised within 24 months from the date of
approval.
31. To the fullest extent permitted by law, applicant shall indemnify, defend and hold
harmless City, its City Council, its boards and commissions, officials, officers, employees,
and agents from and against any and all claims, demands, obligations, damages,
actions, causes of action, suits, losses, judgments, fines, penalties, liabilities, costs and
expenses (including without limitation, attorney's fees, disbursements and court costs) of
every kind and nature whatsoever which may arise from or in any manner relate (directly
or indirectly) to City's approval of Mobilitie Obelisk Telecom including, but not limited to
Telecommunications Permit No. TP2013 -001 (PA2013 -003) and the determination that
the project is exempt under the requirements of the California Environmental Quality Act.
This indemnification shall include, but not be limited to, damages awarded against the
City, if any, costs of suit, attorneys' fees, and other expenses incurred in connection with

PERMIT NO. TP2013 -001 FOR A TELECOMMUNICATIONS
FACILITY LOCATED AT 20661 NEWPORT COAST DRIVE
(PA2013 -003)
THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH HEREBY FINDS AS FOLLOWS:
SECTION 1. STATEMENT OF FACTS.
An application was filed by Mobilitie, with respect to property located at 20661 Newport
Coast Drive, legally described as Block 128 of the Irvine Subdivision, requesting
approval of a Telecommunications ('Telecom ") Permit pursuant to Chapter 15.70 of the
Newport Beach Municipal Code.
2. The applicant requests a Telecom Permit to install a 55 -foot high stealth Telecom
facility (obelisk). The proposal includes the installation of panel antennas and
equipment for Verizon Wireless. The design can accommodate one additional carrier
within the obelisk and equipment area for a total of two carriers. Should the facility be
approved, the second carrier would be required to obtain a separate Telecom approval
pursuant to Municipal Code Chapter 15.70 (Wireless Telecommunication Facilities).
3. The subject property is located within the Parks and Recreation (PR) Zoning District and
the General Plan land use designation is Parks and Recreation (PR).
4. The subject property is not located within the coastal zone.
5. Pursuant to Municipal Code Section 15.70.050.A.2 Special Review by City Council was
held on June 11, 2013, in the City Hall Council Chambers, 100 Civic Center Drive,
Newport Beach, California. A notice of time, place and purpose of the meeting was
given in accordance with the Newport Beach Municipal Code. Evidence, both written
and oral, was presented to, and considered by, the City Council at this meeting.
SECTION 2. CALIFORNIA ENVIRONMENTAL QUALITY ACT DETERMINATION.
Pursuant to Section 15270 of the California Environmental Quality Act ( "CEQA ") Guidelines,
projects which a public agency rejects or disapproves are not subject to CEQA review.
SECTION 3. REQUIRED FINDINGS.
The City Council may approve a Telecom Permit application only after making each of the
required findings set forth in Section 15.70.070.F.3 of the Newport Beach Municipal Code. In
this case, the City Council was unable to make the required findings based upon the
following:

property owners, residents, and businesses due to the height, location, and design of

SECTION 4. DECISION.

Project Overview
Mobilitie LLC is a tower management company that builds and acquires infrastructure throughout North
America, South America and Europe. By providing existing infrastructure for co- location, Mobilitie LLC
provides a competitive solution for wireless, wireline, and public sector customers in the current
dynamic business environment, allowing for preservation of capital while accomodating market
demand and FCC mandated emergency services for ever - expanding network capabilities.
Mobilitie LLC proposes to construct, operate, and maintain an unmanned co- locatable wireless
communications facility consisting of a 55' high tapered obelisk structure capable of housing two
carriers in a 29' x 50' lease area. Each carrier will have the capacity for twelve (12) antennas totalling
twenty -four (24) inside the obelisk structure with details as follows:
Mobilitie LLC has secured Verizon Wireless as an anchor tenant for the proposed structure with
equipment consisting of six (6) panel antennas, four (4) GIPS antennas, 2 equipment cabinets and a
diesel generator. Additional request of six (6) panel antennas, one (1) GPS antenna, and 2 equipment
cabinets will be available for a future tenant for colocation purposes.
The parcel is owned by OC Waste & Recycling and serves as a landfill. The proposed project located is
on a paved area removed from the landfill and methane operations and approved by OC Waste &
Recycle. Legal access is from gated entrance at 20661 Newport Coast Dr.
Planning /Zoning Designation
The project is a Conditional Use Permit for an unmanned wireless telecommunications facility in the PR
(Parks & Recreation) zone subject to Chapter 15.70 of the NBMC. Per Section 20.30.060.C.1 and
20.30.060.C.2.d. of the NBMC, the height of a structure in a non - residential and nonshorline area can
have a height of up to 55' with a sloped design subject to a discretionary use permit.

informed that the area was re -zoned to open space and wireless facilities were not allowed. In addition,
the mission statement of Mobilitie is to develop and maintain multi- carrier facilities, therefore locating
on another carrier's facility is not a feasible solution.
20661 Newport Coast Dr. - Mobilitie had submitted an application in November of 2011 in a joint
venture with Caltrans for stealth light standards in the ROW under PA- 2011 -208. Caltrans denied the
proposal and would not allow access rights which forced Mobilitie to abandon this endeavor and
withdraw the application.
Site Selection Exhibit 8.05
For more than a decade, existing coverage for Verizon has been weak with a high probability of dropped
calls in this area along Newport Coast Dr. as illustrated in Exhibit 6.03. Numerous wireless carriers have
also been searching for locations along Newport Coast Dr. to improved network coverage for their
customers, however this has posed to be a very challenging area for site selection in general due to
property owner interest, regulatory, topographical, and environmental factors. Mobilitie's mission is to
identify areas that do not have existing infrastructure to accommodate multiple carriers, so that
placement of a new facility provides wireless, wireline, and public sector customers with a cost - effective
and efficient avenue to expand network coverage in areas previously unattainable, and provides an
alternative to individual wireless carriers erecting their own separate structures in any given area. The
objective is to propose a co- locatable facility that meets the development standards of the NBMC and
minimize proliferation of new sites while proving much needed wireless coverage in this area of
Newport Beach.
As indicated in Exhibit 8.04, the applicant has conducted due diligence in attempting to secure a site in
this area. As the options substantially narrowed, this is now the only viable location given property
owner interest, topography, and coverage objective.
The site cannot move further south due to possible interference with existing Verizon facility 'Newport
Ridge' (Exhibit 6.05) which is currently too far from the coverage objective area, causing dropping calls
near the intersection of Newport Coast and the 73 Toll Road entrance. Sage Hill High School dominates
the eastern side of Newport Coast, and they have been approached several times to no success. Further
north of the coverage objective area is residential, and by further northwest is too far from the coverage

a. The approval is necessary to allow the facility to function as intended and identified alternatives to
the proposal are not feasible.
Verizon Wireless has extremely weak coverage with a high probability of dropped calls in this area along
Newport Coast Dr. as illustrated in Exhibit 6.03. The'blue' or poorest coverage area indicated on the
coverage map is approximately Y: mile in diameter and affects not only the existing Sage Hill High School
campus, but also along Newport Coast Dr. for approximately one mile, as well as locations near the
entrance of the 73 Toll Road. These are locations of major usage by current subscribers and the need
for a dedicated facility here is imminent.
The proposed facility, if approved and operational, will fill the void as illustrated in Exhibit 6.05.
This dedicated facility will provide the entire Sage Hill High School campus with service, as well as
commuters along Newport Coast Dr. and the 73 Toll Road entrance. Most importantly, the approximate
one mile of optimal coverage along Newport Coast Dr. will address the dropped calls issue for current
subscribers.

property owners, residents, and businesses, nor to public health or safety.
The goal of the applicant is to design a co- locatable facility that functions to minimize proliferation of
new sites while adhering to the development standards of the NBMC. The facility is fully stealthed and
at a total height of S3' -1" which is within the parameters of Section 15.70.050A.2 for review by City
Council.
The parcel is owned by OC Waste & Recycling and is approximately 98 acres in size. With the exception
of Sage Hill High School, there are no known residential or business establishments in the immediate
vicinity. The location of the proposed facility is adjacent to Newport Coast Drive and the existing TCA
conservation land. There are no known neighboring property owners that would be detrimentally
affected by the proposal of a wireless facility, as the existing property is on a landfill that is currently
used for methane gas production.
The location, size, design, and operating characteristics of the proposed facility will not create unusual
noise, traffic or other conditions or situations that may be objectionable, detrimental or incompatible
with the surrounding land uses. The proposed use is consistent with this finding in that:
1. The proposed equipment associated with the telecommunication structure operates quietly
or virtually noise free.

2. The equipment does not emit fumes, smoke, or odors that could be considered
objectionable.
3. The telecommunications facility is unmanned and only requires periodic maintenance, which
equates to approximately one trip per month. The proposed communication facility will not
result in conditions or circumstances contrary to the public health, safety and the general
welfare. The proposed use is consistent with this finding in that:
Unlike other land uses, which can be spatially determined through the General Plan or other land use
plans, the location of wireless telecommunications facilities are based on technical requirements which
include service area, geographical elevations, alignment with neighboring sites and customer demand
components. Placement within the urban geography is dependent on these requirements. Accordingly,
wireless telecommunication facilities have been located adjacent to and within all major land use
categories including residential, commercial, industrial, open space, etc. proving to be compatible in all
locations.
The proposed facility at the subject location will be unmanned, have no impact on circulation systems,
and generate no noise, odor, smoke, or any other adverse impacts to adjacent land uses. The proposed
facility will allow commuters and residents within the coverage area wireless access to the rapidly
expanding communications infrastructure by providing optimal voice and data transmission services.
This proposed wireless telecommunications facility will operate in full compliance with all state and
federal regulations including the Telecommunications Act of 1996.
