HomeMy WebLinkAbout7633 - Release of Excess Right-of-WayRESOLUTION NO. 7633 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH REQUESTING THE CALIFORNIA DIVISION OF HIGHWAYS TO RELEASE CERTAIN EX- CESS RIGHT OF WAY IN THE CITY OF NEWPORT BEACH TO ALLOW FOR PRODUCTIVE USE OF PROPERTY WHEREAS, without ever entering into a freeway agreement for the proposed Route l Pacific Coast Freeway over the westerly section of the City, the State Division of Highways has acquired considerable right of way in West. Newport Beach; and WHEREAS, the City has consistently demonstrated its unwill- ingness to approve the proposed Pacific Coast Highway route and has actively opposed significant portions of the route since 1963; and WHEREAS, the State Division of Highways has purchased and withheld a considerable number of parcels of land without justifica- tion and for unnecessary reasons; and WHEREAS, the result of these unnecessary and unauthorized right of way acquisitions is an untold loss of tax revenue as well as personal losses to private landowners adjacent to and in the im- mediate vicinity of right of way purchased by the State since these properties have not been developed for other worthwhile and beneficial purposes; and WHEREAS, at a special election held on March 9, 1971 a ballot proposition mandating the City Council to rescind the freeway agreement on the portion of the route between Bayside Drive and Buck Gully was overwhelmingly approved by the voters of the City; and WHEREAS, any future freeway agreements require by City Charter a vote of the people; and WHEREAS, on May 24, 1971, the City Council adopted Resolution No. 7443, rescinding the freeway agreement between the City of Newport Beach and the State of California as it relates to that portion of the Route ,l (Pacific Coast) Freeway between the easterly Newport Beach city limit near Buck Gully and Bayside Drive on the west; and -1- i .,'� WHEREAS, in light of said election and rescission it is evident that the construction of a freeway along the rescinded route between Bayside Drive and Corona del Mar is absolutely unacceptable freeway agreement on the proposed route westerly of Bayside Drive; and WHEREAS, there is no longer any reason for the State to retain this property, especially those parcels in the westerly section of New- port Beach which were acquired without first obtaining.a freeway agree- ment from the City of Newport Beach; and WHEREAS, the State Department of Public Works on 13 July 1971 stated that the State - proposed Pacific Coast Freeway route through Newport Beach is dead and buried; and WHEREAS, the Governor has supported a new Coastal Freeway Policy designed to prevent unwarranted intrusion by the State freeway system on the California coastline; NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Newport Beach requests that the State of California Division of Highways release this excess property along the proposed.Pacific Coast Freeway Route, thereby allowing its return for other productive public or private uses and development which would be in the best interest of the taxpayers of this community. BE IT FURTHER RESOLVED that the City of Newport Beach peti- tions the Commission on California State Government Organization and Economy to exert their efforts to an early and effective correction of these problems.
