RESOLUTION NO,
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NEWPORT BEACH ORDERING THE
VACATION, CLOSING UP AND ABANDONMENT OF
PORTIONS OF BAYSIDE DRIVE, WESTERLY OF
JAMBOREE ROAD
WHEREAS, the City Council of the City of Newport
Beach did, on the 10th day of April, 1972, pass its certain
Resolution of Intention No. 7669, declaring its intention to
order the vacation, closing up and abandonment of portions
of a certain street known as Bayside Drive, westerly of
Jamboree Road, in the City of Newport Beach, hereinafter
more particularly described, pursuant to and in accordance
with the "Street Vacation Act of 1941," and all amendments
thereto, being Sections 8300 to 8331, inclusive, of the
Streets & Highways Code of the State of California; and
WHEREAS, the Street Superintendent of the City of
Newport Beach has caused to be posted conspicuously along the
line of the portion of said street proposed to be vacated,
not more than 300 feet apart, and not less than three in all,
notices of the vacation of said portion of said street, all
of which will more fully appear from the affidavit of
Joseph T. Devlin, Street Superintendent of the City of
Newport Beach, on file in these proceedings; and
WHEREAS, said notices so posted by the Street Superin-
tendent of the City of Newport Beach stated the passage of
said Resolution of Intention No. 7669 aforesaid, and the time
and place of the hearing of all persons interested in or
objecting to the proposed vacation of said portion of said
street; and
WHEREAS, the City Council of the City of Newport
1PBeach did set Monday, May 8, 1972, at 7:30 p.m. of said day
as the time, and the Council Chamber of the City Council of

the City of Newport Beach, located in the City Hall at 3300
Newport Boulevard, Newport Beach, California, as the place for
the hearing of all persons interested in or objecting to the
proposed vacation of said portion of said street; and
WHEREAS, said Resolution of Intention No. 7669
aforesaid has been published at least once in the Newport
Harbor Ensign, the official newspaper of the City, and said
publication was made more than 15 days prior to the date set
for the hearing of all persons interested in or objecting to
the proposed vacation, all of which will more fully appear by
the affidavit of Arvo E. Haapa, Printer and Publisher of the
Newport Harbor Ensign, on file in these proceedings; and
WHEREAS, the City Council of the City of Newport
Beach has heard the evidence, both written and verbal, of all
persons interested in the vacation of said portion of said
street in this resolution more particularly hereinafter
described, and finds from all the evidence submitted that said
portion of said street described in said Resolution of Intention,
and hereinafter described, is unnecessary for present or
prospective public street purposes;
NOW, THEREFORE, the City Council of the City of
Newport Beach HEREBY FINDS AND
AND HEREBY ORDERS
that the following described portions of that certain street
known as Bayside Drive in the City of Newport Beach, to wit:
PARCEL 1
That portion of Block 94 of Irvine's Subdivision, as
shown on a map recorded in Book 1, page 88 of Miscellaneous
Record Maps, in the office of the County Recorder of Orange
County, California, described as follows:
BEGINNING at a point in the southerly right -of -way
line of Bayside Drive, as described in a deed to the
County of Orange recorded in Book 830, page 217 of Official
Records of said Orange County, said point being distant
along said southerly right -of -way line and its westerly
prolongation, South 84 046133" East, 1170.60 feet from a

1 -1/2 inch pipe and nail designated "Station 8" on a map
of Tract 4003, recorded in Book 188, pages 13 through
19, inclusive, of Miscellaneous Maps, records of said
Orange County; thence leaving said southerly right -of -way
line North 5 °13'27" East, 60.00 feet to the TRUE POINT
OF BEGINNING; thence continuing North 5 013'27" East,
9.30 feet to a point in a non - tangent curve, concave
northwesterly, having a radius of 100.00 feet, a radial
line from said point bears North 19 °41'10" West; thence
northwesterly 15.69 feet along said curve through a
central angle of 8 °59'28" to a line parallel with and
distant 77.00 feet, northerly as measured at right angles
from said southerly right -of -way line of Bayside Drive;
thence South 84 °46'33" East, 82.39 feet along said parallel
line to the beginning of a non - tangent curve, concave
southeasterly, having a radius of 108.00 feet, a radial
line from said point bears South 18 °19'55" East; thence
southwesterly 11.57 feet along said curve through a central
angle of 6 008'15" to a point of reverse curvature with a
curve, concave northwesterly, having a radius of 90.00
feet, a radial line from said point bears North 24 028'10"
West; thence southwesterly 46.64 feet along said curve
through a central angle of 29 °41'37" to a line parallel
with and distant 60.00 feet, northerly as measured at
right angles from said southerly right -of -way line of
Bayside Drive; thence North 84 046'33" West, 41.13 feet
along said parallel line to the TRUE POINT OF BEGINNING.
CONTAINING: 0.029 acres, more or less, gross.
PARCEL 2
That portion of Block 94 of Irvine's Subdivision,
as shown on a map recorded in Book 1, page 88 of
Miscellaneous Record Maps, in the office of the County
Recorder of Orange County, California, described as
follows:
BEGINNING at an angle point in the southerly right -
of -way line of Bayside Drive, as described in a deed to
the County of Orange recorded in Book 830, page 217 of
Official Records of said Orange County, said point being
distant along said southerly right -of -way line and its
westerly prolongation, South 84 °46'33" East, 1569.68 feet
from a 1 -1/2 inch pipe and nail designated "Station 8"
on a map of Tract No. 4003, recorded in Book 188, pages
13 through 19, inclusive, of Miscellaneous Maps, records
of said Orange County; thence along said southerly right -
of -way line South 84 °48'56" East, 367.61 feet to a non -
tangent curve, concave northeasterly and having a radius
of 855.00 feet, a radial line from said point bears North
11 °23'07" East; thence northwesterly along said curve
3.12 feet, through a central angle of 0 °12'33" to the
TRUE POINT OF BEGINNING of this description; thence
continuing along said curve 281.87 feet through a central
angle of 18 °53'20" to a non - tangent line parallel with and
distant 77.00 feet, northerly as measured at right angles
from said southerly right -of -way line; thence along
said parallel line North 84 °48'56" West, 67.89 feet to

a non - tangent curve, concave northeasterly and having a
radius of 892.00 feet, a radial line from said beginning
bears North 29 009'57" East; thence southeasterly along
said curve 348.61 feet through a central angle of
22 023"33" to the TRUE POINT OF BEGINNING.
CONTAINING: 0.100 acres, more or less, gross;
is unncessary for present or prospective public street purposes,
and that it be vacated, closed up and abandoned. Those portions
of said street to be vacated, closed up and abandoned are more
clearly shown on the attached parcel map marked Exhibit "B"
and made a part of this resolution by this reference.
The City Council further finds and determines, and
it is hereby ordered that the public easement in the portions
of said street as heretofore described as Parcels 1 and 2
have upon passage of this resolution, ceased except that the
City reserves an easement for public utility purposes over
parcel 2 only.
The City Council further orders that the City Clerk
of the City of Newport Beach shall cause a certified copy of
this Order, duly attested by her as the City Clerk, under
the seal of the City, to be recorded in the Office of the
County Recorder of the County of Orange, State of California,
immediately following the passage of this resolution.
