TITLE: Balboa Village Business Improvement District FY 2012 -2013
Annual Report
ABSTRACT:
The Central Balboa Business Improvement District, a.k.a., the Balboa Village Business
Improvement District (Balboa Village BID) Advisory Board has submitted the BID's FY
2012 -2013 annual report for City Council approval. This is the final, annual report for the
Balboa Village BID as it will be disestablished effective June 30, 2013.
RECOMMENDATION:
1. Receive, approve and file the FY 2012 -2013 Annual Report of the Balboa Village
Business Improvement District.
FUNDING REQUIREMENTS:
There is no fiscal impact related to this item.

DISCUSSION:
The Balboa Village BID was formed pursuant to the Parking and Business Improvement
Area Law of 1989, codified in California Streets and Highways Code Sections 36500 et
seq. (Act), for the purpose of financing activities and programs to benefit businesses
located and operating in the territory of the BID. The Balboa Village BID's territory
encompasses the area between A Street and Coronado Street on the Balboa
Peninsula.
California Streets and Highways Code Section 36533 requires the Balboa Village BID
Advisory Board to prepare and submit the attached annual report (Attachment A) for the
Council's review and approval. The report includes a summary of the BID's FY 2012 —
2013 accomplishments. This will be the final annual report submitted by the Balboa
Village BID as it is scheduled to be disestablished on June 30, 2013.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will
not result in a direct or reasonably foreseeable indirect physical change in the
environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378)
of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it
has no potential for resulting in physical change to the environment, directly or
indirectly.
NOTICING:
This agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers this item).

BALBOA VILLAGE BUSINESS IMPROVEMENT DISTRICT
FISCAL YEAR 2012 -2013 ANNUAL REPORT
This is the annual report for the seventeenth year of the Balboa Village Business Improvement
District. As required by Section 36533 of the California Streets and Highways Code, the annual
report shall contain the following information:
1) Proposed Changes to the District Boundary
There are no changes proposed to the district boundaries as the Balboa Village Business
Improvement District will be disestablished effective June 30, 2013 pursuant to Ordinance
No. 2013 -13, adopted by the City Council May 28, 2013.
2) Improvement and Activities for the Fiscal Year of July 1, 2013 to June 30, 2014
Not applicable.
3) The Cost of These Activities Is Projected as Follows:
Not applicable.
4) The Method and Basis of Levying the Assessment Shall be as Follows:
There will be no future levies following the disestablishment of the BID.
5) Surplus Carryover from Fiscal Year 2012 -2013
In accordance with California Streets and Highways Code Section 36551; any remaining
revenues derived from the levy of assessments or any revenues derived from the sale of
assets acquired with the revenues shall be refunded to the owners of the businesses
operating within the BID that are current in their annual assessment by applying the same
method and basis that was used to calculate the assessment levied this fiscal year. Any BID
assets (such as street furniture, holiday decor, the website) must be sold or donated to a
nonprofit organization prior to the BID's disestablishment. On May 14, 2013, the Balboa
Village Board voted in favor of donating the BID's assets to the City of Newport Beach.
6) Sources of Contributions Other Than Levied Assessments
Not applicable.
7) Past Year Accomplishments
The Balboa Village BID instituted and completed the following projects and initiatives
during FY 2012 -2013:
o The BID launched a complete redesign of the Balboa Village website. The user - friendly
site includes a comprehensive events calendar, merchant directory, quick response links and
social media integration. Implementation of a strategic search engine optimization plan
resulted in greater visibility for the business district.
a Balboa Village was the official venue for the Newport Beach Christmas Boat Parade and
continued its traditional community tree lighting event. Other holiday activities included
storefront painting by Newport Beach Elementary School students, horse -drawn wagon
rides and live music.
o The BID continued its holiday decor program as well as banner programs, highlighting the
holiday season, promoting special events and creating a sense of place.
o The BID worked with the Balboa Village Advisory Committee on parking- related issues in
the village. Work will continue to address or research solutions for parking validation,
employee parking, residential parking permits, shuttle service and establishment of a
parking management district.
o The BID coordinated and hosted an expanded number of kick -off events for the sixty-sixth
annual Newport to Ensenada Race. The Lexus Newport to Ensenada Race kick -off events,
in conjunction with ExplorOcean/Newport Harbor Nautical Museum, Newport Ocean
Sailing Association (NOSA) and Newport Beach & Company, included Strada dell'Arte
chalk festival, a children's chalk art fundraiser hosted by Newport Beach Elementary
School as well as OC Imagination Celebration activities.
As part of the Lexus Newport to Ensenada kick -off events, the BID hosted the first -ever
Stroll, Sample and Sip —Taste of Balboa. The event included a Stella Artois/Mount Gay
Rum beer garden, and local merchant and race vendor displays along the boardwalk,
including Discover Baja California.
o In addition to special events, the BID's ongoing marketing efforts promoted its Family Fun
Zone Fridays, and live music and horse -drawn carriage activities on Sunday afternoons
through banners, posters, newspaper articles and advertising and network television spots,
including a feature on Good Day LA. Additional print advertising promoting the business
district prominently featured a Balboa Village map in the Newport Beach area map.
The merchants of the Balboa Village BID want to thank the City Council and City of Newport
Beach for their financial support and efforts on behalf of the BID for the past 17 years.
