TITLE: Amendment of the Balboa Village Advisory Committee Membership
ABSTRACT:
Membership of the Balboa Village Advisory Committee (BVAC) includes a Board
Member from the Balboa Village Business Improvement District (BID) which was
disestablished on June 30, 2013. The Balboa Village businesses have formulated a
new group called the Balboa Village Merchant Association (BVMA).
RECOMMENDATION:
a) Adopt Resolution No. 2013- 58 - Amending the Membership of the Balboa
Village Advisory Committee to replace the "Balboa Village Business
Improvement District Board Member' with a "Balboa Village Merchant
Association Board Member ";
b) Waive Council Policy A -2 (Board, Commission and Committee Appointments);
and
c) Appoint Ralph Rodheim to fill the Balboa Village Merchant Association Board
Member seat.

There is no fiscal impact related to this item
DISCUSSION:
The BVAC has met monthly since December 2012 and has made significant progress in
creating the projects and program parameters to implement the Balboa Village Master
Plan. Maintaining the current membership is important for continuity. Equally important
is ensuring representation of the business community. With the elimination of the BID, it
is necessary to amend the membership of the BVAC, to replace the BID Board member
with a board member of the newly formed BVMA. It is assumed that Ralph Rodheim
will continue to fulfill this role.
ENVIRONMENTAL REVIEW:
This action is not subject to the California Environmental Quality Act ( "CEQA ") pursuant
to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable
indirect physical change in the environment) and 15060(c)(3) (the activity is not a
project as defined in Section 15378) of the CEQA Guidelines, California Code of
Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical
change to the environment, directly or indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item).

RESOLUTION NO 2012-
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT
BEACH AMENDING MEMBERSHIP OF THE BALBOA VILLAGE
ADVISORY COMMITTEE
WHEREAS, on September 25, 2012, the City Council created the Balboa Village
Advisory Committee to oversee the timely implementation of recommendations provided in
the Balboa Village Implementation Plan; and
WHEREAS, the Committee is made up of seven (7) members consisting of two (2)
City Council members, one of which shall represent District 1, one (1) Balboa Village
Business Improvement District Board Member, one (1) representative of ExplorOcean, one
(1) representative of the Balboa Peninsula Point Homeowners Association, one (1)
representative of the Central Newport Beach Community Association, and one (1) at large
member; and
WHEREAS, the City Council disestablished the Balboa Village Business
Improvement District which became effective June 30, 2013; and
WHEREAS, Balboa Village business owners have formulated the "Balboa Village
Merchant Association" to provide a united voice for the business community in the area.
NOW, THEREFORE, the City Council of the City of Newport Beach resolves as
follows:
SECTION 1. Amend the membership of the Balboa Village Advisory Committee to
replace the "Balboa Village Business Improvement District Board Member" with the 'Balboa
Village Merchant Association Board Member."
SECTION 2. The full description of the Committee is set forth in Exhibit A, which is
incorporated by reference.
SECTION 3. This resolution shall take effect immediately upon its adoption by the
City Council, and the City Clerk shall certify the vote adopting the resolution.
ADOPTED this gth day of July, 2013.

BALBOA VILLAGE ADVISORY COMMITTEE
AUTHORIZATION: Established by Resolution No. 2013- adopted on 2013.
MEMBERSHIP: Two members of the City Council, one of whom shall represent Council
District 1, who shall Chair the Committee.
One Balboa Village Merchant Association Business Board Member.
One representative of ExplorOcean.
One representative of the Balboa Peninsula Point Homeowners Association.
One representative of the Central Newport Beach Community Association.
One representative selected at- large.
All appointments are made by the Mayor and ratified by the City Council.
City staff support shall come from the Community Development Department,
Public Works Department, and others as needed.
TERM: Term ends December 31, 2016.
MEETS: The Committee shall meet regularly with the schedule determined by the
Committee.
PURPOSE & RESPONSIBILITIES:
A. Oversee the timely implementation of recommendations provided in the
Balboa Village Implementation Plan approved by the City Council,
including the establishment of appropriate priorities consistent with City
Council directives.
B. Provide recommendations to the City Council regarding: 1) the adoption
of specific programs or projects consistent with the Implementation Plan;
and 2) allocation of funding for Balboa Village projects derived from a
proposed Parking Benefit District and other sources.
C. Provide recommendations to the City Council regarding the addition,
modification, or elimination of revitalization strategies.
D. Provide recommendations to the governing board of a proposed Parking
Benefit District for Balboa Village.
E. Such other matters as directed by the City Council.
