TITLE: Summary Vacation f Existing Sewer Easements at 212, 216, 220
and 224 Kings Place
ABSTRACT:
The property owners of 212, 216, 220 and 224 Kings Place are requesting that the City
summarily vacate the sewer easements at 212, 216, 220 and 224 Kings Place.
RECOMMENDATIONS:
Staff recommends that the City Council:
1. Adopt a Resolution ordering the summary vacation of existing sewer easement
at 212 Kings Place.
2. Adopt a Resolution ordering the summary vacation of existing sewer easement
at 216 Kings Place.
3. Adopt a Resolution ordering the summary vacation of existing sewer easement
at 220 Kings Place.
4. Adopt a Resolution ordering the summary vacation of existing sewer easement
at 224 Kings Place.
5. Direct staff to process the summary vacation of said easements, and direct the
City Clerk to have all Resolutions and summary vacation documents recorded
by the Orange County Recorder.

FUNDING REQUIREMENTS:
There is no fiscal impact related to this item
DISCUSSION:
As part of the City Sewer Improvements project in 2006, the old 6 -inch sewer main
which ran along the hillside through the properties at 212, 216, 220 and 224 Kings
Place was abandoned in place and a new 8 -inch sewer main was constructed along
Cliff Drive to service the adjacent properties. As part of the sewer main project, new
private sewer laterals were extended down the bluff in order to reconnect the affected
properties to the new 8 -inch sewer main in Cliff Drive. Although the 6 -inch sewer main
was abandoned, the existing 10 -foot wide easement remained in place.
Recently, the Public Works Department received request from the various property
owners to vacate said sewer easements that run across their properties that are no
longer needed. Once said sewer easements are vacated, property owners will be able
to use the land without any easement restrictions.
Pursuant to the California Streets and Highway Code Section 8330 et sea., the City
Council may summarily vacate a City easement if the following condition exists: (1) the
easement is unnecessary for present or prospective sewer purposes. The proposed
summarily vacated easement satisfies the condition of the California Streets and
Highways Code since the said easement is not needed for sewer purposes. The
existing easement to be summarily vacated is legally described in Exhibit "A" and shown
in Exhibit "B" of the attached Resolutions.
ENVIRONMENTAL REVIEW:
Staff recommends the City Council find this action is not subject to the California
Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will
not result in a direct or reasonably foreseeable indirect physical change in the
environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378)
of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it
has no potential for resulting in physical change to the environment, directly or
indirectly.
NOTICING:
The agenda item has been noticed according to the Brown Act (72 hours in advance of
the meeting at which the City Council considers the item) and Streets and Highways
Code Sections 8322 and 8323.

BEACH ORDERING THE SUMMARY VACATION OF AN EXISTING 10-
FOOT WIDE SEWER EASEMENT AT 212 KINGS PLACE (LOT 5,
BLOCK D OF TRACT 1219); AND DIRECTING THE CITY CLERK TO
RECORD SAME WITH THE COUNTY RECORDER'S OFFICE
WHEREAS, the City Council of the City of Newport Beach pursuant to Chapter 4
of the California Streets and Highways code (Sections 8330 et sea.), is authorized to
summarily vacate public easements; and
WHEREAS, the City Council of the City of Newport Beach has received a
request from the property owner of 212 Kings Place to summarily vacate a 10 -foot wide
sewer easement legally described in Exhibit "A" and shown in Exhibit "B "; and
WHEREAS, the City has abandoned a 6 -inch sewer main within said easement
at 212 Kings Place; and
WHEREAS, the City, as part of the abandonment, constructed an 8 -inch sewer
main along Cliff Drive and reconnected 212 Kings Place; and
WHEREAS, the City Council of the City of Newport Beach has reviewed and
considered the various elements of the General Plan of the City of Newport Beach prior
to declaring its intent to summarily vacate the easement on these properties and has
determined that the proposed summary vacation is consistent with the General Plan;
and

WHEREAS, the summarily vacated sewer easement is unnecessary for future
sewer line purposes; and
WHEREAS, a Notice of Vacation was published for at least two (2) successive
weeks prior to the hearing in a newspaper of general circulation in the City of Newport
Beach; and
WHEREAS, that at least two (2) weeks before the day set for hearing, Notices of
the proposed summary vacation were conspicuously posted adjacent to the easement,
and that Notices were posted not more than three hundred feet (300) apart along Kings
Place and Cliff Drive. The notices stated the day, hour, and place of the hearing.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Newport Beach that the sewer easement legally described in Exhibit "A" and shown in
Exhibit "B" are hereby ordered vacated and abandoned.
BE IT FURTHER RESOLVED that the City Clerk is hereby directed to have this
Resolution and easement documents recorded by the Orange County Recorder.

Notice is hereby given that the City Council of the City of Newport Beach will consider the
vacation of sewer easements. The vacation process will be conducted pursuant to the
California Street and Highways Code Section 8300 et. seg. — Public Streets, Highways and
Service Easements Vacation Law. The sewer easements proposed to be vacated are
described below.
Being a vacation of a portion of a 10 -foot wide sewer easement granted to the City of Newport Beach,
California, by Resolution of Acceptance recorded in Book 3237, Pages 507 through 523, of Official Record of
Orange County, described in said Resolution of Acceptance as:
"Being over a portion of Lots 2 to 10 inclusive of Block D, Tract #1219 as shown upon a map recorded in Book
38, pages 26,27 of Miscellaneous Maps, Records of Orange County, California, and being ten feet in width, five
feet (6) on each side of the following described center lines;
