Assistant Planner APPROVED: 0, V TITLE: Medical Office Building Use Permit Appeal 441 Old Newport Boulevard Use Permit No. UP2011-011 (PA2011-056) ABSTRACT: On September 19, 2012, the applicant appealed the Planning Commission's denial of Conditional Use Permit No. UP2011-011, which was a request to reduce the required number of off-street parking spaces and to allow parking on the adjacent property at 445 Old Newport Boulevard. The applicant proposes to lease the recently renovated commercial office building (11,540 square feet) entirely for medical office uses and to reduce the required onsite parking spaces from 56 to 51. The proposal also provided 44 parking spaces on site and 7 spaces on the adjacent 445 Old Newport Boulevard property, which is developed with a restaurant that has been vacant for a number of years. A parking management plan that included a valet parking service was also proposed. Subsequent to the filing of the appeal, the applicant has modified the project by securing the ability to improve the adjacent property at 445 Old Newport Boulevard to accommodate a total of 15 parking spaces during the day as opposed to 7 parking spaces. Combined, the proposed on-site and off-site parking spaces will provide the minimum parking spaces required by the Zoning Code for medical uses. FUNDING REQUIREMENTS: There is no fiscal impact related to this item. ENVIRONMENTAL REVIEW: It is recommended that the City Council take no action in regards to the subject application but rather refer it to the Planning Commission for review and action. Environmental review of the proposed project will be undertaken when action is taken in accordance with the California Environmental Quality Act. A notice was published in the Daily Pilot, mailed to all property owners within 300 feet of the property, and posted at the site a minimum of 10 days in advance of the hearing consistent with the Municipal Code. The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
