TITLE: Ocean Boulevard and China Cove Ramp Median Slope
Maintenance - Notice of Completion and Acceptance of Contract
No. 3912
ABSTRACT:
On September 11, 2012, City Council awarded Contract No. 3912, Ocean Boulevard and
China Cove Ramp Median Slope Maintenance project to D.J. Scheffler Inc., for a total
contract cost of $391,125 plus a 15% allowance for contingencies. The required work is now
complete and staff requests City Council acceptance and close out of the contract.
RECOMMENDATIONS:
1. Accept the completed work and authorize the City Clerk to file a Notice of Completion
for the project.
2. Authorize the City Clerk to release the Labor and Materials Bond 65 days after the
Notice of Completion has been recorded in accordance with applicable. portions of
the Civil Code.
3. Release the Faithful Performance Bond one year after this Council acceptance.

The work necessary for the completion of this contract consisted of removing the existing
ice plant vegetation and other unsuitable loose materials, constructing a soil nailed sculpted
architectural rock hardscape surface, installing new landscaping and irrigation, and.
replacing a 4 -inch sewer force main along the east side of the wall.
The contract has now been completed to the satisfaction of the Public Works Department.

The final construction contract cost was approximately 12.5% above the original bid amount.
The majority of this additional cost increase ($48,382) was a result of increasing the square
footage of sculpted architectural rock hardscape surface to address additional steep slope
areas as recommended by the consulting geotechnical engineer based on the field soil
conditions and testing results. Additional plant material was also provided and modifications
were made to the cable rail fence at the request of the residents on Ocean Boulevard,
increasing the work scope by $4,200.

City Council found this project exempt from the California Environmental Quality Act
( "CEQK) pursuant to Section 15301(c). This exemption covers the minor alteration of
existing public facilities with negligible expansion of the facilities in areas that are not
environmentally sensitive.
NOTICING:
This agenda item has been noticed according to the Brown Act (72 hours in advance of the
meeting at which the City Council considers the item). In addition, the City Clerk will be filing
a Notice of Completion for the project as a result of this action.
The Notice Inviting Bids was advertised in the City's official publication and in construction
industry publications.
