Mayor Curry and Members of the City Council:
I am writing on behalf of our thirty-five residential unit 28th Street Marina Homeowners' Association
at 2600 and 2700 Newport Blvd. Woody's new claim that it has now conducted a "noise
measurement survey" and has determined how to install a roof over its outdoor patio does nothing to
address the real issue that after 10 PM Woody's becomes a nightclub with dancing, strobe lights and
overcrowding until 2 AM and this violates a number of city permit conditions. As a nightclub, Woody's
contributes significantly to the degradation of our neighborhood. Further, Woody's "noise
measurement survey" has no merit because it was conducted during the winter when temperatures
were in the low 40's, while business was typically slow, especially on the outdoor patio, and while a
tent covered the patio. This survey cannot be representative of the noise Woody's generates during
the summer.
The staff recommendation to refer this matter back to the Planning Commission serves no
constructive purpose but simply further delays the resolution of the issue. This is another delaying
tactic by Woody's ... as summer approaches once again. Woody's has so far asked that the hearing
concerning its citations be delayed, it asked that the original date set for the Planning Commission to
hear this matter be rescheduled, it asked that the original date set for the Council to hear this matter
be rescheduled and now it wants the matter sent back to the Planning Commission. It has asked for
delays and rescheduling at every stage of the process. These delaying tactics only benefit Woody's.
The real issue is that Woody's is currently operating as a nightclub after 10 PM in violation of a
number of city permit and Alcoholic Beverage Control license conditions with all the resulting noise,
crime and negative impact on our neighborhood. The real issue cannot be resolved by a sound
measurement survey or a patio roof. Referring this matter back to the Planning Commission serves
no constructive purpose, it only allows Woody's to further delay the resolution. Please do not refer
the matter back to the Planning Commission but instead support the local residents, the Police
Department, the Planning Commission and the Finance Department and resolve this matter now by
denying Woody's appeal and application.
