RECOMMENDATION: Initiate a General Plan Amendment for the 2014 -2021 Housing Element Update. FUNDING REQUIREMENTS: The current adopted budget includes sufficient funding to complete this amendment. Staff estimates that approximately 450 hours will be spent on this effort plus the cost of noticing and publishing materials for workshops and public hearings. DISCUSSION: The Housing Element is one of the mandatory elements of the General Plan, and State law requires it to be updated periodically. Pursuant to State law, the Housing Element Update for the 2014 -2021 planning period is due for review and approval by the State Department of Housing and Community Development (HCD) by October 15, 2013. The Newport Beach Housing Element details the City's strategy for enhancing and preserving the community's character and identifies constraints to the development of housing. It also identifies strategies for expanding housing opportunities and services 1 Housing Element Update Initiation March 12, 2013 Page 2 for all household types and income groups. It provides the primary policy guidance for local decision - making related to housing. It is important to note that HCD found the 2008 -2014 Housing Element to be consistent with the statuary requirements of State law, and the City Council subsequently adopted it on November 11, 2011. Staff anticipates that the draft 2014 -2021 Housing Element will incorporate significant information and data from the current Housing Element, and include necessary refinements and new programs to address changed circumstances within the community. ENVIRONMENTAL REVIEW: Staff recommends the City Council find the initiation of the General Plan Amendment is not subject to the California Environmental Quality Act ( "CEQA ") pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly. Prior to the City Council adoption of the Housing Element, appropriate CEQA documents will be prepared and required public hearings held. NOTICING: The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).
