A RESOLUTION OF INTENTION OF THE CITY COUNCIL
OF THE CITY OF NEWPORT BEACH DECLARING ITS
INTENTION TO ORDER THE VACATION AND ABANDONMENT
OF A TEN FOOT WALKWAY RUNNING SOUTHEASTERLY
• FROM THE INTERSECTION OF SETTING SUN DRIVE AND
SANDPIPER DRIVE ALONG THE NORTHEASTERLY EDGE
OF LOT 27, TRACT NO. 3660, IN THE CITY OF
NEWPORT BEACH
The City Council of the City of Newport Beach under
the provisions of the "Public Service Easements Vacation Law"
and amendments thereto, Section 50430 et. seq. of the California
Government Code, does hereby resolve and declare as follows:
SECTION 1. The public interest and convenience require,
and it is the intention of the City Council of the City of
Newport Beach to order the vacation and abandonment of a ten foot
wide walkway easement running generally southeasterly from the
intersection of Setting Sun Drive and Sandpiper Drive, along the
northeasterly edge of Lot 27, Tract No. 3660 in the City of
Newport Beach, and, over and on that certain real property described
as follows:
A strip of land being a portion of Lot 27, Tract
3660, as shown on a map recorded in Book 144,
pages 9 through 11 of Miscellaneous Maps, in the
office of the County Recorder, County of Orange,
State of California, said strip being the most
northeasterly 10.00 feet, of said lot, measured
at right angles from the northeasterly line thereof.
The Southwesterly line of said strip being pro-
longed or shortened to terminate in the Northeasterly
and Southeasterly lines of said Lot 27.
Said walkway easement to be vacated and abandoned is
shown on a certain map entitled "Vacation and Abandonment of the
Public Walkway Interest in an Existing Walkway and Storm Drain
Easement" prepared by the City of Newport Beach, Public Works
Department, dated June 29, 1975, a copy of which is attached
• hereto, marked Exhibit "A" and incorporated herein by this reference.
SECTION 2. The proceedings for the vacation and
abandonment of said easement are taken pursuant to, and the City
Council of the City of Newport Beach hereby elects to proceed

under the provisions of, the "Public Service Easement Vacation
Law" and all amendments thereto, being Sections 50430 to 50445,
inclusive, of the California Government Code.
SECTION 3, The Public Works Director of the City of
Newport Beach shall cause to be conspicuously posted along the
line of said easement proposed to be vacated and abandoned, not
more than 300 feet apart, and not less than three in all, notices
of the vacation and abandonment of said easement. The notices
Shall state the passage of this Resolution of Intention and
the time and place of the hearing before the City Council of all
persons interested in or objecting to the proposed vacation and
abandonment. Said notices shall be posted at least ten (10) days
before the date of said hearing.
SECTION 4, It is intended that the City of Newport
Beach will reserve all right, title and interest in and to the
existing storm drain easement located in the same position as and
coterminous with the walkway easement to be abandoned and vacated.
SECTION 5, Notice is hereby given that the City Council
of the City of Newport Beach does hereby fix Monday, the 11th day
of August, 1975, at the hour of 7 :30 P.M. on said day in the Council
Chambers located in the City Hall of the City of Newport Beach
at 3300 Newport Boulevard, Newport Beach, California, as the time
and place for hearing all persons interested in or objecting to
the proposed vacation and abandonment of said walkway easement.
SECTION 6. A notice of the hearing hereinabove set,
giving the date, time and place of said hearing, shall be published
by the City Clerk in the official newspaper of the City once each
week for at least two successive weeks prior to said hearing.
ADOPTED this 14th day of July , 1975.
