RESOLUTION NO. 8604
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF NEWPORT BEACH CONFIRMING THE
COST OF CONSTRUCTING ALLEY IMPROVEMENTS
A14D ASSESSING SAID COSTS AGAINST CERTAIN
REAL PROPERTY PURSUANT TO THE PROVISIONS
OF CHAPTER 27, DIVISION 7 OF THE CALIFOR-
NIA STREETS AND HIGHWAYS CODE (BLOCK 10,
EAST NEWPORT)(BLOCK BOUNDED BY 6TH STREET,
ISLAND AVENUE, BALBOA BOULEVARD AND OCEAN
FRONT)
WHEREAS, on November 12, 1973, the City Council
directed the Public Works Director (acting as Superintendent
of Streets) to notify the owners of the real property located
in Block 10, East Newport, to construct alley improvements
in accordance with the procedure set forth in Chapter 27,
Division 7 of the Streets and Highways Code; and
WHEREAS, notice was given to each owner or person
in possession pursuant to the requirements of Section 5877 of
the Streets and Highways Code, and on the 15th day of October,
1974, a public hearing was held by the City Council to consider
protests and objections to the proposed improvements; and
WHEREAS, after the close of said hearing the City
Council after passing upon such objections or protests ordered
that the improvements be constructed; and
WHEREAS, the Superintendent of Streets has completed
the construction of said improvements and has given notice of
the cost of the construction to the owners or persons in
possession of .the affected property and has filed a report with
the City Council specifying the workmanship which has been done,
the cost of construction and other information as required by
Section 5882 of the Streets and Highways Code; and
WHEREAS, on the 14th day of October, 1975, the City
Council held a hearing for the purpose of passing upon the
report of the Superintendent of Streets and to hear any objections
or protests by property owners liable to be assessed for such
construction, and any other interested persons;

NOW, THEREFORE, the City Council of the City of
Newport Beach does hereby RESOLVE, DECLARE AND ORDER, as
follows:
SECTION 1. The report filed by the Public Works
• Department dated September 8, 1975, concerning the work
• completed on the alley improvements in Block 10, East Newport,
is hereby confirmed, and all protests by persons owning
property liable to be assessed for such work are overruled.
SECTION 2. The cost of the construction is hereby
assessed against the parcels of property fronting upon the
improvements so constructed, which parcels are described by
the County Assessor's parcel number,, and the amounts of the
assessment applicable to each parcel are hereinafter set forth:

SECTION 3: The assessments set forth in Section 2
hereof shall be a lien upon the respective parcel from the time
of recordation of a Notice of Lien, which lien shall continue
until the assessment and all interest thereon is paid, or unitl
it is discharged of record.
SECTION 4: The City Council hereby determines that
• the.payment of the assessments set forth in Section 2 hereof
. may be paid in three equal annual installments which shall
bear interest on the unpaid balance at the rate of 7% per annum,

provided, however, the Ebell Club of East Newport, owner of
Assessor Parcel No. 48- 073 -21 may pay said assessment in ten
equal annual installments, which shall bear interest on the
unpaid balance at the rate of 7% per annum; all said interest
shall commence to run on the 31st day after the adoption of
this Resolution by the City Council.
