RESOLUTION NO. 8728
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AUTHORIZING THE MAYOR AND
CITY CLERK TO EXECUTE A QUITCLAIM DEED FOR
AN EXISTING 4 -FOOT WIDE STORM DRAIN EASEMENT
IN CONNECTION WITH THE CONVERSION OF THE MAI
KAI APARTMENTS TO CONDOMINIUMS
WHEREAS, the City of Newport Beach owns a 4 -foot
wide storm drain easement over that portion of real property
more particularly described as follows.
and
"The southeasterly 4.00 feet of Lot 4,
Tract No. 3232, as shown on a map recorded in
Book 99, pages 49 and 50 of Miscellaneous Maps,
in the office of the County Recorder of Orange
County, California."
WHEREAS, said storm drain easement was dedicated to
the City as part of the original Mai Kai apartment development
to be used for possible storm drain relocation should the
existing storm drain fail. The Mai Kai apartments were permitted
to be built over the existing storm drains; and
WHEREAS, as a condition to the approval of Tentative
Map No. 8917 (Mai Kai Apartments - Condominium Conversion), the
subdivider has agreed to dedicate a 12 -foot wide storm drain
easement adjacent to the southeasterly boundary line to be used
for possible future storm drain reconstruction should the existing
system fail; and
WHEREAS, the 4 -foot wide storm drain easement described
hereinabove is no longer needed by the City in light of the
12 -foot wide back up storm drain easement which will be dedicated
by the subdivider.
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Newport Beach hereby authorizes and directs the Mayor

and City Clerk to execute a quitclaim deed to The Irvine Company
for the 4 -foot wide storm drain easement located along the
southeasterly boundary line of the Mai Kai development more
particularly described as hereinabove.
